3658 ARTICLE 10 <br />3659 FRANCHISE FEE AND OTHER FEES <br />3660 10.01 GENERAL <br />3661 <br />The fees described in this Article shall be treated as Other Pass -Through Costs for the <br />3662 <br />purposes of determining the Revenue Requirement and shall be recoverable through the <br />3663 <br />Agency -approved Rates and Charges that are collected from Customers. <br />3664 10.02 FRANCHISE FEE <br />3665 <br />In consideration of the exclusive franchise granted to Contractor by this Agreement, and <br />3666 <br />to reimburse Agency for costs incurred in administering this Agreement, Contractor shall <br />3667 <br />pay to Agency a Franchise Fee specified in Attachment M. <br />3668 10.03 OTHER FEES <br />3669 Agency has adopted other fees, which are intended to recover the costs of services <br />3670 related to Solid Waste management, Recycling, and cleanliness of public streets and/or <br />3671 public litter and Recycling containers through inclusion in Rates. The other fees <br />3672 currently in effect, or which are expected to be in effect as of January 1, 2021 are listed <br />3673 in Attachment M. <br />3674 10.04 TIME AND METHOD OF PAYMENT <br />3675 On or before the twentieth (20'") Day of each month, Agency shall remit revenues <br />3676 received from Customers minus (i) the amount of the Franchise Fees due on Gross <br />3677 Revenues Billed during the immediate previous month, (ii) payments by Agency to <br />3678 SBWMA for deliveries to Shoreway, and (iii) other fees, including one -twelfth of any <br />3679 other fee established by Agency, unless Agency directs a different payment schedule for <br />3680 such other fees. Agency's obligation to pay Contractor is expressly limited to those <br />3681 revenues received from Customers. <br />3682 Agency shall provide, concurrently with the remittance of payment, a statement showing <br />3683 the calculation of each fee, including the Gross Revenues Billed from Customers in each <br />3684 Service Sector for that month. Payments from Agency to Contractor shall be made by a <br />3685 method mutually acceptable to Agency and Contractor. <br />3686 10.05 ADJUSTMENTS TO FEES; ADDITIONAL FEES <br />3687 Agency may from time to time adjust the amount of the fees described in this Article and <br />3688 may establish other fees.
