REPORT <br />To the Honorable Mayor and City Council <br />From the City Manager <br /> <br />June 25, 2018 <br /> <br />SUBJECT <br />Approval of the General and Special Release to Resolve Litigation in Foley, et al. v. City <br />of Redwood City, et al., 16CIV02347 <br /> <br />RECOMMENDATION <br />By motion, approve settlement as memorialized in the General and Special Release in <br />Foley, et al. v. City of Redwood City, et al., 16CIV02347 <br /> <br /> <br />BACKGROUND <br />This is a lawsuit arising out of an incident which allegedly occurred on or about <br />December 9, 2015 at 227 Park Street in Redwood City, California. The parties reached <br />a global settlement, whereby the City would pay $175,000 in full and final settlement of <br />all claims. The terms have been memorialized in a General and Special Release. <br /> <br />ANALYSIS <br />The City Attorney’s Office recommends approval of the settlement as delineated in the <br />General and Special Release. <br /> <br />ALTERNATIVES <br />The City Council could elect not to approve the settlement. <br /> <br />FISCAL IMPACT <br />The settlement proceeds will be withdrawn from the City’s general liability fund. <br /> <br />ENVIRONMENTAL REVIEW <br />This activity is not a project under CEQA as defined in the CEQA Guidelines, section <br />15378, because it has no potential for resulting in either a direct or foreseeable physical <br />change in the environment. <br /> <br /> <br />M.
