<br />Page 24 of 45 <br />ATTY/CHARTER AMENDMENTS/2018/2018 DRAFT CHARTER AMENDMENTS <br />REV: 06-25-18 VR <br />of the Board, and such other officers, employees and agents as may be necessary in the efficient <br />and economical carrying out of its functions and to prescribe and fix their duties, authority and <br />compensation, and to require such officers, employees and agents to give a bond in such an <br />amount as the Board may require for the faithful discharge of their duties. All offices and places <br />of employment in the permanent service of the Board shall be created by ordinance duly passed. <br /> <br />(12) To provide and equip offices. <br /> <br />(13) To expend all funds necessary to the carrying out of the powers and duties herein <br />expressed. <br /> <br />(14) To adopt and enforce such ordinances, orders, regulations and practices, as are necessary <br />for the proper administration and discharge of its duties and powers, or for the management and <br />government of the Port, and its facilities. <br /> <br />(15) To prescribe fines, forfeitures and penalties for the violation of any provision of Sections <br />47 to 50a of this Charter, or of any ordinance, but no penalty shall exceed five hundred dollars <br />($500) fine, or six months imprisonment, or both. <br /> <br />(16) To have and exercise the right of eminent domain within the "Port Area," on behalf of and <br />in the name of the City of Redwood City, for Port purposes, harbor development or the carrying <br />out of any of the powers granted to said Board, and to exclusively find and determine by <br />ordinance adopted by a four <br />-fifths (4/5ths) vote of all its members the public interest and necessity thereof. <br /> <br />(17) To appoint a Port Attorney who shall be the same person who is at that time cCity <br />aAttorney and who shall continue to act as Port Attorney during such time as he they may <br />continue to be cCity aAttorney, whose duty it shall be to pass upon the form and legality of all <br />contracts within the jurisdiction of the Board, give legal advice to the Board on official matters, <br />defend and (subject to direction from the Board) prosecute or compromise all actions at law or <br />in equity and special proceedings for or against the City of Redwood City or any officer thereof in <br />his their official capacity, pertaining to matters within the jurisdiction of the Board. The Board <br />shall fix and provide for his their compensation which shall be in addition to his their <br />compensation from the cCity as cCity aAttorney. <br /> <br />(18) To do and perform any and all other acts and things which may be necessary and proper <br />to carry out the general powers of the cCity, or any of the provisions of Sections 47 to 50a of this <br />Charter, and to exercise all powers not in conflict with the constitution of the sState, or with this <br />Charter, germane to the scope of is powers, purposes and duties.
