Page 38 of 45 ATTY/CHARTER AMENDMENTS/2018/2018 DRAFT CHARTER AMENDMENTS REV: 06-25-18 VR As used in this Charter, the masculine gender includes the feminine, and the terms "man" or "men" where appropriate shall be deemed to mean "person" or "persons", respectively. Any references to one gender in Sections of this Charter shall be changed to include both genders or to the singular or plural form of "person", as appropriate, when such Sections are amended. (As added April 10, 1984, certified by Secretary of State June 21, 1984.) Section 73. OFFICE VACATED: If any officer of the cCity shall remove from the cCity, or be absent himself therefrom for more than 30 days consecutively without the per-mission of the cCouncil, or if he they shall fail to qualify by taking the oath of office and filing his their official bond, whenever such bond is required, within 15 days from the time his their certificate of election or appointment is mailed or delivered to him them , or if he they shall resign, or if he they shall be convicted of felony, or if he they shall be adjudged insane, or if he they shall cease to discharge the duties of his their office (other than that of member of the cCouncil) for two consecutive months, unless prevented by sickness, his their office shall be vacant. Section 74: STREETS AND OTHER PUBLIC IMPROVENMENTS UNDER GENERAL LAWS: The improvement, widening, extending, opening and closing of streets or rights of way owned by said cCity or in which said City has an easement, whether within or without the limits thereof, and the planting of trees thereon, and the making of any other improvements authorized by the laws of the State may be done and assessments therefor may be levied in conformity with and under the authority conferred by the general laws of the State now in effect or which may hereafter be enacted; provided, however, that the Council may by ordinance adopt a procedure for the improvements of streets, alleys, rights of way or other public places, the laying of pipe and conduits and the removal from buildings, lots and grounds, and the sidewalks opposite thereto, of dirt, rubbish, weeds and other rank growth and materials which may injure or endanger neighboring property or the health or welfare of the inhabitants of said cCity, and for making and enforcing assessments against the property benefited or affected thereby or from which such removal is made for cost of such improvements or removal, and may make such assessments a lien on such property superior to all other claims or liens thereon except sState, county and municipal taxes, but no such ordinance shall prevent or limit the cCouncil from proceeding under any of the general laws of the State now in effect or which may be hereafter enacted, referring to said purposes. It is the intention of this Charter to permit the cCouncil of said cCity to proceed in all matters referred to in this section under the general laws of the State now in effect or hereafter to be enacted. Section 75. BOOKS AND RECORDS TO SUCCESSORS: All officers and boards shall deliver to their successors all papers, books, documents, records, archives and other properties pertaining to their respective offices or departments, in their possession or under their control. 8.A. - Page 46
