Any <br />references to one gender in Sections of this Charter shall be changed to include both genders or <br />to the singular or plural form of "person", as appropriate, when such Sections are amended. (As <br />added April 10, 1984, certified by Secretary of State June 21, 1984.) <br /> <br />Section 73. OFFICE VACATED: <br /> <br />If any officer of the cCity shall remove from the cCity, or be absent himself therefrom for more <br />than 30 days consecutively without the per-mission of the cCouncil, or if he they shall fail to <br />qualify by taking the oath of office and filing his their official bond, whenever such bond is <br />required, within 15 days from the time his their certificate of election or appointment is mailed or <br />delivered to him them , or if he they shall resign, or if he they shall be convicted of felony, or if he <br />they shall be adjudged insane, or if he they shall cease to discharge the duties of his their office <br />(other than that of member of the cCouncil) for two consecutive months, unless prevented by <br />sickness, his their office shall be vacant. <br /> <br />Section 74: STREETS AND OTHER PUBLIC IMPROVENMENTS UNDER GENERAL <br />LAWS: <br /> <br />The improvement, widening, extending, opening and closing of streets or rights of way owned by <br />said cCity or in which said City has an easement, whether within or without the limits thereof, <br />and the planting of trees thereon, and the making of any other improvements authorized by the <br />laws of the State may be done and assessments therefor may be levied in conformity with and <br />under the authority conferred by the general laws of the State now in effect or which may <br />hereafter be enacted; provided, however, that the Council may by ordinance adopt a procedure <br />for the improvements of streets, alleys, rights of way or other public places, the laying of pipe and <br />conduits and the removal from buildings, lots and grounds, and the sidewalks opposite thereto, <br />of dirt, rubbish, weeds and other rank growth and materials which may injure or endanger <br />neighboring property or the health or welfare of the inhabitants of said cCity, and for making and <br />enforcing assessments against the property benefited or affected thereby or from which such <br />removal is made for cost of such improvements or removal, and may make such assessments a <br />lien on such property superior to all other claims or liens thereon except sState, county and <br />municipal taxes, but no such ordinance shall prevent or limit the cCouncil from proceeding under <br />any of the general laws of the State now in effect or which may be hereafter enacted, referring to <br />said purposes. It is the intention of this Charter to permit the cCouncil of said cCity to proceed <br />in all matters referred to in this section under the general laws of the State now in effect or <br />hereafter to be enacted. <br /> <br />Section 75. BOOKS AND RECORDS TO SUCCESSORS: <br /> <br />All officers and boards shall deliver to their successors all papers, books, documents, records, <br />archives and other properties pertaining to their respective offices or departments, in their <br />possession or under their control. <br /> <br />8.A. - Page 46
