AMENDMENT NO. 1 <br /> TO REVOCABLE LICENSE AGREEMENT <br /> <br /> [DASARO'S, LLC] <br /> <br /> THIS AMENDMENT NO. 1 is made and entered into this day of <br />August, 2002, by and between the City of Redwood City, a charter city and municipal <br />corporation of the State of California ("City") and Dasaro's LLC ("Licensee") <br /> <br /> RECITALS <br /> <br /> WHEREAS, on February 12, 2002, Licensee obtained a Revocable License by <br />Agreement with the City of Redwood City (the "Agreement") to use a portion of City Hall <br />Plaza for outdoor seating, tables and limited related improvements for the outdoor <br />restaurant and caf(~; and <br /> <br /> WHEREAS, Licensee is now requesting an amendment to the Agreement for the <br />installation of a small (90 square foot) portable flower stand (the "Flower Stand"); and <br /> <br /> WHEREAS, City has determined that the Flower Stand is compatible with <br />sidewalk cafes and is expected to further enliven pedestrian experience in the public <br />space which would otherwise remain empty; and <br /> <br /> WHEREAS, on August 13, 2002, the Architectural Review Committee approved <br />the proposed design of the Flower Stand. <br /> <br /> NOW, THEREFORE, the parties agree to amend the Agreement as follows: <br /> <br /> 1. The definition of "lmprovetnents" contained in recital D of the Agreement <br />is hereby amended to include the Flower Stand as specified in the Plans approved by <br />the Architectural Review Committee on August 13, 2002, and attached hereto as <br />Exhibit "A." <br /> <br /> 2. The City reserves the right to rearrange the proposed location of the <br />Flower Stand if it is determined by City that {he structure interferes with public use, <br />access and/or enjoyment of the space. <br /> <br /> 3.
