Council Member Jordan asked City Attorney Yamamoto to explain the background <br /> on the item to be considered. <br /> <br /> City Attorney Yamamoto stated that last month, the Council was asked to adopt a <br /> resolution to authorize the collection by the County of the NPDES discharge fees. <br /> On or about June 3, 2002, there was a court of appeals decision that was cited <br /> against the City of Salinas. The court of appeals found that the manner in which <br /> the City of Salinas collected its storm water fees was in violation of Proposition <br /> 218. San Mateo County has advised the City that there are two fees: One was <br /> collected in the eady 1990's, which is called the basic fee. Subsequently, there <br /> have been additional costs incurred as a result of additional requirements of local <br /> entities by the Federal Government, and that is the supplemental fee.
