Council Member Jordan asked City Attorney Yamamoto to explain the background <br /> on the item to be considered. <br /> <br /> City Attorney Yamamoto stated that last month, the Council was asked to adopt a <br /> resolution to authorize the collection by the County of the NPDES discharge fees. <br /> On or about June 3, 2002, there was a court of appeals decision that was cited <br /> against the City of Salinas. The court of appeals found that the manner in which <br /> the City of Salinas collected its storm water fees was in violation of Proposition <br /> 218. San Mateo County has advised the City that there are two fees: One was <br /> collected in the eady 1990's, which is called the basic fee. Subsequently, there <br /> have been additional costs incurred as a result of additional requirements of local <br /> entities by the Federal Government, and that is the supplemental fee. The County <br /> is asking the City to separate out the two fees and adopt two separate resolutions. <br /> <br /> MIS Hartnett/Howard to repeal Resolution No. 14449 and approve the following <br /> resolutions: <br /> <br /> i) RESOLUTION 14457 OF THE CITY OF REDWOOD CITY RECOMMENDING THAT <br /> THE THE SAN MATEO COUNTY FLOOD CONTROL DISTRICT IMPOSE CHARGES <br /> FOR FUNDING THE 2002/2003 COUNTYWIDE NATIONAL POLLUTION <br /> DISCHARGE ELIMINATION SYSTEM (NPDES) GENERAL PROGRAM; (802) <br /> <br /> ii)RESOLUTION 14458 OF THE CITY OF REDWOOD CITY RECOMMENDING THAT <br /> THE SAN MATEO COUNTY FLOOD CONTROL DISTRICT IMPOSE ADDITIONAL <br />-- CHARGES FOR FUNDING THE EXPANDED SCOPE OF WORK FOR THE <br /> 2002/2003 COUNTYWIDE NATIONAL POLLUTION DISCHARGE ELIMINATION <br /> SYSTEM (NPDES) GENERAL PROGRAM; (802) <br /> <br /> iii) To approve an Agreement Regarding Fees for Funding the NPDES <br /> Program for San Mateo County; (304) <br /> <br /> The motion passed by a majority roll call vote with Council Member Jordan voting <br /> no and Council Member Pierce and Vice Mayor Ira absent. <br /> MINUTE ORDER 02.201 <br /> <br /> RECESS TO THE BOARD OF EQUALIZATION MEETING <br /> <br /> BOARD OF EQUALIZA TION MEETING (SEE SEPARATE MINUTES) <br /> <br /> 8.
