City of Redwood City, et al., 17CIV02727 <br />RECOMMENDATION <br />By motion, approve settlement as memorialized in the Settlement Agreement and <br />Release in 605 Middlefield, LLC, et. al. v. City of Redwood City, et. al., 17CIV02727 <br />BACKGROUND <br />Petitioners, 605 Middlefield, LLC, et al. ("Petitioners") filed a lawsuit on California <br />Environmental Quality Act (CEQA) grounds in opposition to the City Council's May 22, <br />2017 approval of an affordable housing residential condominium project at 612 <br />Jefferson Avenue, containing 20 units, proposed by Habitat for Humanity Greater San <br />Francisco ("Habitat") <br />ANALYSIS <br />The City Attorney's Office recommends approval of the Settlement as delineated in the <br />Settlement Agreement and Release. <br />ALTERNATIVES <br />The City Council could elect not to approve the settlement. <br />FISCAL IMPACT <br />No Fiscal Impact. <br />ENVIRONMENTAL REVIEW <br />This activity is not a project under CEQA as defined in the CEQA Guidelines, section <br />15278, because it has no potential for resulting in either a direct or foreseeable physical <br />change in the environment. <br />
