Code § 27383. <br />IMPROVEMENT AGREEMENT <br />601 Marshall Street <br />THIS IMPROVEMENT AGREEMENT ("Agreement") is made and entered into on this _ day of <br />TU L9 6 , 20L ("Effective Date") by and between by and between 601 Marshall Street <br />Owner, LLC, a Delaware limited liability company ("Developer"), and the CITY OF <br />REDWOOD CITY, a charter city and California municipal corporation ("City") with reference <br />to the following facts: <br />RECITALS <br />A . Developer is the current fee owner of that certain real property consisting of <br />approximately 0.7 acres located within the City of Redwood City, County of San Mateo, State of <br />California, described in Exhibit A. attached hereto and incorporated herein by reference (the "Property"). <br />B. On November 16, 2015, the City Council of the City of Redwood City adopted, among <br />other approvals, Resolution No. 15458, approving the Vesting Tentative Map for the 601 Marshall Street <br />Project ("Project'), prepared by BKF Engineers and dated June 5, 2015 ("Tentative Map"), subject to <br />certain conditions of approval ("Conditions"). <br />C . The Conditions require either (1) that certain public improvements for the Project be <br />constructed prior to approval of the parcel map ("Final Map" ), or (2) that Developer enter into an <br />agreement with City providing for the future construction of such public improvements. <br />D . Developer has submitted the Final Map and applied to City for Final Map approval <br />without having completed the required public improvements and, therefore, will enter into an agreement <br />with City providing for the future construction and installation of such public improvements, as required <br />by Government Code section 66462(a)(1). <br />E . Developer has submitted to City, and City has approved, plans, specifications and <br />drawings entitled Improvement Plans for 601 Marshall Street, prepared by BKF Engineers and dated <br />Z l , 20_LL�,(the "Improvement Plans"), which, in addition to other improvements, provide for <br />certaiA on-site public improvements consisting of street and street light improvements, storm drain <br />systems, domestic water systems and sanitary sewer systems for the Project (collectively, <br />"Improvements"). <br />F.
