Conviction for cultivation or production of a controlled substance on <br />public or private lands pursuant to Section 12025 or 12025.1 of the <br />Fish and Game Code. <br />h. Conviction for unauthorized, unpermitted, or unlawful cannabis <br />activities in any city, county or city and county in the five years <br />immediately preceding the issuance of a cannabis business permit <br />or cannabis business permit renewal. <br />4. The applicant; and each owners, and managers have not been <br />convicted, cited, fined, or penalized by the State or any city, county, or <br />city and county, or enjoined by any court of law, in the five years <br />immediately preceding the application for a cannabis business permit or <br />cannabis business permit renewal, for any unauthorized, unpermitted, <br />or unlawful cannabis activities. <br />5. The applicant; and each owners, and managers have not been <br />convicted, cited, fined, or penalized by the State or any city, county, or <br />city and county, or enjoined by any court of law, in the five years <br />immediately preceding the application for a cannabis business permit or <br />cannabis business permit renewal, for cultivation or production of a <br />controlled substance on public or private lands. <br />6. Security Plan. The applicant has provided a Security Plan that meets <br />the minimum standards set forth in these regulations and any applicable <br />City Manager regulations. <br />C. A cannabis business permit shall not be issued or renewed where the Assistant <br />City Manager confirms that one or more of the criterion set forth in Section <br />32.161(B) have not been met. A cannabis business permit also shall not be issued <br />or renewed where the Assistant City Manager determines that the application <br />contains a material falsehood or misrepresentation and/or omission of information <br />required by these regulations, any applicable City Manager regulations, and/or the <br />approved application form. If the Assistant City Manager denies the cannabis <br />business permit or cannabis business permit renewal, he or she shall specify in <br />writing the reasons for the denial of the application or application for renewal, and <br />the decision shall become final unless the applicant seeks an appeal pursuant to <br />Section 32.164 of this Division. <br />D. Each cannabis business permit issued pursuant to this Division shall expire twelve <br />(12) months after the date that the Assistant City Manager or his or her designee <br />mails the approved cannabis business permit to the person authorized to accept <br />service of process on the applicant's behalf. Where a use permit is reauired to <br />oaerate the cannabis businessFer a nurseFy, the date of issuance for a cannabis <br />business permit shall be the date on which a use permit is issued pursuant to <br />Article 42 of the Zoning Ordinance. <br />E.
