6A.C. - Page 2 <br />market. Regarding the Minimum Lease Term Ordinance, the City Council requested that <br />staff remove language that tied month-to-month rental rates to an equivalent 12 -month <br />(one year) lease term. <br />Subsequent to the March 26, 2018 meeting, staff met with representatives of SAMCAR <br />to discuss additional revisions and ordinance clarifications. The revisions clarify the <br />requirements and process. The revisions do not change policy or the original purpose of <br />the ordinances. <br />On June 26, 2018, the City Council waived the first reading, re -introduced, and then <br />approved the revised ordinances on the consent agenda. No ordinance changes are <br />proposed since the June 26 Council action. <br />If adopted, these ordinances will become effective on January 1, 2019. Throughout the <br />remainder of 2018, staff would continue to educate the community on the provisions <br />and requirements of both ordinances, and establish the necessary administrative <br />processes to implement the ordinances. <br />ALTERNATIVES <br />The City Council may consider the following alternatives: <br />1. Adopt the ordinances with changes, which could require additional environmental <br />review. <br />2. Do not adopt the ordinances. <br />FISCAL IMPACT <br />The fiscal impact of these ordinances includes the cost of staff time to enforce the <br />ordinances. The Minimum Lease Terms ordinance will require staff to develop new <br />public outreach communications and provide enforcement as necessary. The <br />Relocation Assistance Ordinance includes the cost of staff time to implement the <br />provisions of the ordinance including reviewing relocation assistance applications and <br />identifying a relocation assistance vendor. A fee to recover the cost of staff time will be <br />determined through the preparation of a nexus study. Once the City Council adopts the <br />fee, the fee can be used to offset expenses to administer the requirements of these <br />ordinances. <br />ENVIRONMENTAL REVIEW <br />Adoption of the Minimum Lease Terms ordinance is not a project within the meaning of <br />the California Environmental Quality Act (CEQA) because the ordinance will not result in <br />a direct or reasonably foreseeable indirect physical change in the environment (CEQA <br />Guidelines Section 15378).
