-- District Agreement No. 4-1933-C <br /> <br />10. To prepare the "Proposed Final Estimate~ no later than thirty ($0) days after acceptance <br /> of the construction contract for IMPROVEMENT in accordance with Section 7-1.17 of <br /> STATE's current Standard Specifications, or advise CITY of the status of the alternative <br /> date for submittal. <br /> <br />11. To provide CITY with As-Built drawings for the completed IMPROVEMENTS to the City <br /> upon completion of the PROJECT. <br /> <br /> SECTION II <br /> <br />CIT~ AGREES: <br /> <br />1. To pay one hundred percent (100%) of the actual cost of IMPROVEMENT, including the <br /> cost of claims related to the construction of IMPROVEMENT and the cost of STATE's <br /> defense of any of those claims, as determined after completion of work and upon £mal <br /> accounting of costs. The STATE's construction claims process will be used, with <br /> STATE acting as the lead agency in consultation with CITY. CITY shall abide by the <br /> outcome of said claims process. In the event that arbitration under the provisions of <br /> Public Contract Code Section 10240 et. seq. results from the contract claim process. <br /> STATE will act as the lead agency in arbitration unless otherwise agreed by STATE and <br /> <br />2. To grant recycled water usage to STATE after completion of IMPROVEMENT and to <br /> ailow said usage at STATE's discretion. <br /> <br />3. Any negotiations on STATE's usage of CITY's recycle water regarding quantity of water <br /> used and reimbursement to crI~ for usage will be outJined in the Maintenance <br /> Agreement for this project. <br /> <br />4. To pay STATE, within twenty (20) days of receipt of a detailed statement made upon <br /> final accounting of cost thereof, any amo~fnt over and above the amount deposited as <br /> specified in Article (1) of this Section II, required to complete CITY's financial obligation <br /> pursuant to this Agreement. <br /> <br />5. To make all arrangements to provide the construction contractor with permits to enter <br /> and construct on lands outside of the State highway right of way in the event that such <br /> permits are necessary to accommodate the construction of IMPROVEMENT, and to <br /> certify in a form satisfactory to STATE, prior to STATE's bid advertising date for the <br /> construction contract for PROJECT, that such permits have been obtained. <br /> <br /> 6. To provide, at no cost to STATE, qualified support staff and other resources necessary <br /> to accomplish project plans, specifications and estimates according to STATE <br /> standards. This will include preparation of project plans, specifications and estimates <br /> for required IMPROVEMENT. <br /> <br /> 7. That, upon receipt of STATE's complete billing with supporting information, CITY will <br /> endeavor to notify STATE in writing within fourteen (14) working days, of charges with <br /> which CITY disagrees. <br /> <br /> 8. To make supplemental payments when required within twenty (20) calendar days after <br /> receipt of invoice. <br /> <br /> <br />
