TERMINATION OF THE USE OF THE SUBJECT PROPERTY AS THE PRINCIPAL <br />RESIDENCE OF THE UNDERSIGNED; (C) UPON THE SAI.~, TRANSFER OR ALIENATION <br />OF THE SUBJECT PROPERTY; (D) UPON RETIREMENT OF THE INDEBTEDNESS <br />SECURED BY THIS DEED OF TRUST PURSUANT TO THE NOTE; OK (E) THIRTY (30) <br />YEARS AFTER THE COMMENCEMENT DATE OF THE NOTE, WHICHEVER COMES <br />FIRST" and the undersigned agree to be bound thereby. <br /> <br /> The undersigned acknowledge the holding in W{ll~r~k~mp v. Notwithstanding that holding, the undersigned acknowledge that the loan evidenced by this <br />Note is a special purpose loan fashioned for the undersigned alone and, therefore, shall not be <br />assumable and shall be due and payable as provided above. <br /> <br /> The undersigned may prepay at any tune all or a portion of the loan without penalty. <br /> <br /> The undersigned shall maintain the subject property in good condition until all sums owed <br />under this Note are fully paid. <br /> <br /> If this Note is executed by more than one person, the obligations of each person will be joint <br />and several. The undersigned waives presentment; demand; notice of dishonor; notice of default or <br />delinquency; notice of acceleration; notice of protest and nonpayment; notice of costs, expenses or <br />losses and interest; notice of interest on interest and late charges; and diligence in taking any action <br />to collect any sums owing under this Note or in proceeding against any of the rights or interests to <br />properties securing payment of this Note.
