Ordinances shall be published at least once in accordance with <br />procedures established by ordinance of the Council for the publication of ordinances. <br /> <br />Except as otherwise provided by general law, or this cCharter, no action providing for the levying <br />of any tax or assessment, or for the granting of any franchise, or for the establishment or change <br />of zoning regulations, or for the imposition of any penalty of fine or imprisonment, shall be taken <br />except by ordinance. Any and all other legislative action, including any appropriation or <br />expenditure of public money, may be accomplished by resolution. <br /> <br />No ordinance or portion thereof shall be repealed except by ordinance. No ordinance shall be <br />revised, re-enacted, or amended by reference to its title only; but the ordinance to be revised or <br />re-enacted, or the section or sections thereof to be amended, or the new section or sections to be <br />added thereto, shall be set forth and adopted according to the method provided in this section <br />for the enactment of ordinances, and such revision, re-enactment, amendment or addition, shall <br />be done by ordinance only. <br /> <br />All ordinances shall be signed by the Mayor and attested by and filed with the City Clerk; provided, <br />however, the Mayor may sign all ordinances and other legal instruments and documents by <br />facsimile signature. (As amended April 8, 1958, ratified by Legislature April 18, 1958; as amended <br />November 8, 2005, certified by Secretary of State January 24, 2006.) <br /> <br />Section 16. WHEN ORDINANCES EFFECTIVE: <br /> <br />Except as otherwise provided herein every ordinance and every measure passed by the cCouncil <br />granting any franchise or privilege shall go into effect at the expiration of thirty (30) days after its <br />final passage unless otherwise provided in said ordinance or measure, but ordinances declared <br />by the cCouncil to be necessary as emergency measures for the immediate preservation of public <br />peace, health, or safety, containing a statement of the reasons for their urgency and passed by <br />five-sevenths (5/7ths) vote of the whole cCouncil, ordinances ordering or otherwise relating to <br />elections, and ordinances relating to public improvements, the cost of which is to be borne wholly <br />or in part by special assessments, may go into effect at the will of the cCouncil. <br /> <br />Section 17. PLANNING COMMISSION: <br /> <br />There shall be a cCity pPlanning cCommission, which shall consist of seven members, who shall <br />be appointed by the Council, to serve for four (4) years each, and thereafter until their respective <br />successors are appointed and qualified, none of whom shall hold any other public office or <br />position in the City. No person shall be appointed to the Planning Commission for more than <br />four full consecutive terms. A partial term to which a person is appointed to fill a vacancy on the <br />Planning Commission shall not be included in computing consecutive terms. The full term <br />during which a member may resign shall be included in the same manner as if no resignation <br />had taken place. If a member is not reappointed after serving one or more terms, such member <br />may be appointed in a later appointment cycle and shall be eligible to serve four consecutive <br />terms from the date of the later appointment.
