07/23/2018 <br />e. A felony conviction for drug trafficking with enhancements pursuant <br />to Section 11370.4 or 11379.8 of the Health and Safety Code. <br />f. Conviction for any controlled substance felony subsequent to <br />licensure shall be grounds for revocation of a cannabis business <br />permit or denial of a cannabis business permit renewal. <br />g. Conviction for cultivation or production of a controlled substance on <br />public or private lands pursuant to Section 12025 or 12025.1 of the <br />Fish and Game Code. <br />h. Conviction for unauthorized, unpermitted, or unlawful cannabis <br />activities in any city, county or city and county in the five years <br />immediately preceding the issuance of a cannabis business permit <br />or cannabis business permit renewal. <br />4. The applicant; and each owners ac -A nvwwge% have not been <br />convicted, cited, fined, or penalized by the State or any city, county, or <br />city and county, or enjoined by any court of law, in the five years <br />immediately preceding the application for a cannabis business permit <br />or cannabis business permit renewal, for any unauthorized, <br />unpermitted, or unlawful cannabis activities. <br />5. The applicant, and each owner, and rnaRagefs have not been <br />convicted, cited, fined, or penalized by the State or any city, county, or <br />city and county, or enjoined by any court of law, in the five years <br />immediately preceding the application for a cannabis business permit <br />or cannabis business permit renewal, for cultivation or production of a <br />controlled substance on public or private lands. <br />6. Security Plan. The applicant has provided a Security Plan that meets <br />the minimum standards set forth in these regulations and any <br />applicable City Manager regulations. <br />C. A cannabis business permit shall not be issued or renewed where the Assistant <br />City Manager confirms that one or more of the criterion set forth in Section <br />32.161(6) have not been met. A cannabis business permit also shall not be <br />issued or renewed where the Assistant City Manager determines that the <br />application contains a material falsehood or misrepresentation and/or omission of <br />information required by these regulations, any applicable City Manager <br />regulations, and/or the approved application form. If the Assistant City Manager <br />denies the cannabis business permit or cannabis business permit renewal, he or <br />she shall specify in writing the reasons for the denial of the application or <br />application for renewal, and the decision shall become final unless the applicant <br />seeks an appeal pursuant to Section 32.164 of this Division. <br />D. Each cannabis business permit issued pursuant to this Division shall expire <br />twelve (12) months after the date that the Assistant City Manager or his or her <br />designee mails the approved cannabis business permit to the person authorized <br />to accept service of process on the applicant's behalf.
