<br />ancestry in the development, construction, sale, lease, sublease, <br />transfer, use, occupancy, tenure or enjoyment of the Property, the <br />Project, or any to be conveyed therein, nor shall the Grantee or <br />any grantees or any persons claiming under or through the Grantee <br />establish or permit any such practice or practices of <br />discrimination or segregation with reference to the selection, <br />location, number, use or occupancy of tenants, lessees, subtenants, <br />sublessees or vendees in the Property or the Project. This <br />covenant shall remain in effect without limitation as to time. <br /> <br />(d) After the satisfactory completion of the Project in <br />compliance with the Agreement, the Property shall be devoted to the <br />uses specified Article IV of the Agreement, consistent with the <br />Redevelopment Plan and shall not, in whole or in part, be devoted <br />to any other use or used for any other purposes except as may be <br />approved by the Agency in writing in advance. This covenant shall <br />remain in effect for the life of the Redevelopment Plan, as <br />extended from time to time. <br /> <br />(e) <br /> <br />Section 504 of the Rehabilitation Act of 1973 <br /> <br />(1) Pursuant to Section 514 (Public Law 93-112), the <br />Grantee agrees that no otherwise qualified persons with <br />disabilities shall, solely by reason of a disability, be excluded <br />from the participation in, be denied benefits of, or be subjected <br />to discrimination in the performance of the Agreement or in the <br />selection of low income owners to purchase the dwelling to be built <br />on the Property. <br /> <br />(2) Compliance of Section 504 of the Rehabilitation Act <br />of 1973, as amended, requires that all benefits, aids and services <br />are made available to persons with disabilities on an equivalent <br />basis with those received by non-disabled persons. The Grantee <br />shall agree to be in compliance with Section 504 requirements by <br />developing a plan for compliance to be submitted to the Section 504 <br />Coordinator as soon as possible but not later than by the close of <br />escrow for the acquisition of the Property. Certain units within <br />the Project shall be constructed to comply with Section 504 of the <br />Rehabilitation Act of 1973 as set forth in the Scope of <br />Development. <br /> <br />(f) Affirmative Action. The Grantee certifies that it <br />is in compliance with the Equal Employment Opportunity Requirements <br />of Executive Order No 11246, as amended by Executive Order No 1375, <br />Title VII of the Civil Rights Act of 1964, the California Fair <br />Employment Practices Act and any other federal or state laws <br />pertaining to equal employment opportunity, and that it will not <br />discriminate against any employee or applicant for employment or <br />opportunity to purchase the dwelling to be built on the Property on <br />REDW\0006\DOC\001-7 <br />3/29/05 3:15 /rove <br /> <br />G - 4 <br />
