(h) Nondiscrimination Based on Disability. The Grantee hereby agrees that it will, to the extent not otherwise exempt, comply with the provisions of Section 504 of the Rehabilitation Act of 1973, as amended, providing equal access and reasonable accommodations in employment programs and services to persons who are disabled. (i) Interest of Public Officials. No members, officers, employees, or agents of the City of Redwood City, no member of the Ci ty Council and no other public official who exercises any function or responsibility with respect to this Agreement during his or his tenure, or for one year thereafter, shall have any interest, direct or indirect, in this contract or a related subcontract, or the proceeds thereof. The Grantee shall incorporate in all subcontracts hereunder a provision prohibiting such interest. (j) Reliqious Acti vi ty Prohibited. The Grantee covenants that there will be no religious worship, instruction, or proselytizing as part of, or in connection with, the performance or in connection with this Agreement. (k) Uniform Administration Requirements. The Grantee shall comply with the requirements and standards of the HOME Investment Partnership Regulations, OMB Circular A-122 Cost Principles for Non-Profit Organizations, OMB Circular A-110 attachments A, B, C, F, H, N, and 0 and all other federal, state, and local laws, regulations and requirements, as applicable. (I) All of the foregoing covenants shall run with the land, and shall inure to the benefit of and be enforceable by the Agency, and its successors and assigns. (m) The covenants set forth in this Grant Deed shall run in favor of the Agency for the entire period during which such covenants are to remain in force in accordance with the foregoing, and shall be in effect without regard to whether the Agency has at any time been, remains, or is an owner of any land or interest therein to which these covenants relate. In the event of any breach of these covenants, the Agency shall have the right to exercise all the rights and remedies available at law or in equity to enforce the curing of such breach. (n) It is the intent hereof that the provisions of subsections (a) through (K)of this Section 5, inclusive, of this Grant Deed shall survive the termination of the other operative provisions of the Agreement and the issuance and/or recordation of the Certificate of Completion. 6 REDW\0006\DOC\027
