(d) To certify the compliance of OWNER or its successor with these <br />provisions, the City shall have a right to inspect the books and records pertaining to such <br />matters of the then owner(s) or operator(s) of the Property. <br />(e) Each rental agreement or lease for an Affordable Unit must contain <br />a provision to the effect that OWNER has relied on the income certification and supporting <br />information supplied by the tenant in determining qualification for occupancy of the <br />Affordable Unit, and that any material misstatement in such certification (whether or not <br />intentional) will be cause for immediate termination of the rental agreement or lease. <br />Section 4.04. Affordabilitv Compliance Report. <br />Annually prior to December 31st of every year of the Rental Affordability <br />Covenants Term, OWNER shall submit a Report to the City containing, at a minimum, the <br />following items and information: <br />(a) <br />A site map showing the unit numbers and locations of all units <br />and all Affordable Units; <br />(b) <br />Total number of Affordable Units that are occupied; <br />(c) <br />Total number of Affordable Units that are vacant; <br />(d) <br />A certified rent roll for Affordable Units containing the unit numbers, <br />the lease commencement and expiration dates, the numbers of <br />bedrooms and bathrooms within the rented Affordable Units, the <br />rental rate for each rented Affordable Unit, and indicating which <br />units are rented as Affordable Units; <br />(e) <br />For each Affordable Unit, the unit size, household size, household <br />income, income limits for a Qualifying Lessee, Maximum Affordable <br />Rents for a Qualifying Lessee, utility allowance, and total monthly <br />rent. <br />(f) <br />Evidence that the income for each tenant of an Affordable Unit does <br />not exceed the maximum income for a Qualifying Lessee, which <br />such evidence may come in the form of an executed Income <br />Verification and Information Form. <br />(g) <br />Such other information as may be reasonably required by City to <br />determine compliance with the terms of this Agreement. <br />Section 4.05. <br />Affordabilitv Housinq Monitoring Pavment. <br />OWNER shall pay City to cover the administrative cost of compliance monitoring <br />that is designed to confirm adherence to the Affordable Housing Agreement requirements <br />and provide technical assistance to the OWNER, its representatives or management <br />personnel (the "Affordable Housing Monitoring Payment'). City shall only charge OWNER <br />for costs associated with the Affordable Units. The Affordable Housing Monitoring <br />Payment is $162 per unit for each of the following tasks: initial lease up, annual review <br />and reoccupancy. The City shall not charge OWNER for annual review in the same year <br />as the City charges for initial lease up.
