<br />Addendum to Outlease Agreement <br />Between United States Postal Service (Redwood City Downtown Station) and <br />Redwood City Redevelopment Agency) <br /> <br />25. <br /> <br />16. <br /> <br />Lessor shall indemnify and hold hanDless Lessee and its officers, officials, <br />Employees and volunteers from and against all claims, damages, losses and <br />expenses including attorney fees arising out. of the performance of the work <br />described herein, caused in whole or in part by any negligent act or omission <br />ofthe Lessor, anyone directly or indirectly employed by any ofthem or <br />anyone for whose acts any of them m~y be liable, except where caused by the <br />active negligence, sole negligence, or willful misconduct of the Lessee. <br />Notwithstanding the above, the Lessee shall'be under no obligation to save <br />harmless and indemnify the Lessor where the Lessor's active negligence, sole <br />negligence, or willful misconduct causes the loss or claim. <br /> <br />Lessor understands that Lessee wishes to sublease a portion of the premises <br />for restaurant use. The proposed sublease will be submitted to Lessor for <br />approval and will not be entered into until the Lessee secures written <br />approval of the Lessor's contracting officer.
