The design and proposed improvements are likely to cause substantial <br />environmental damage, or substantially and avoidably injure fish, wildlife or their <br />habitat, or cause serious public health problems. <br />The merger of the seven existing parcels into a single parcel would not cause <br />substantial environmental damage, injure fish or wildlife or their habitat, and <br />would not cause serious public health problems because the site is located within <br />an urbanized setting. The site contains an existing office building and a private <br />paved surface parking lot. No new development or site changes are proposed <br />with this Tentative Map application. <br />D. The design or improvements of the proposed subdivision will conflict with <br />essential public easements for access through, or use of, property within the <br />proposed subdivision. <br />The merger of the lots would not conflict with any essential public easements for <br />access through, or use of property within the proposed parcel. The proposed lot <br />merger would maintain an existing storm drain easement and create a new public <br />utility easement along the Hazel Avenue frontage as requested by PG&E. No <br />new development or site changes are proposed with this Tentative Map <br />application. <br />E. Such other findings of conflict with written public policy or with the public interest <br />as the Planning Commission may determine. <br />The proposed project does not conflict with any written public policy or with the <br />public interest. <br />CEQA STATUS <br />The proposed activity is exempt from the requirements of the California Environmental <br />Quality Act (CEQA) pursuant to Section 15061(b)(3). The activity is covered by the <br />general rule that CEQA applies only to projects which have the potential for causing a <br />significant effect on the environment, and it can be seen with certainty that there is no <br />possibility that the activity in question may have a significant effect on the environment. <br />The activity in question is the fulfillment of a previously approved condition of approval, <br />and there is no physical change to the site being approved by the Tentative Parcel Map, <br />or the existing building located on the site. <br />Staff RECOMMENDATION <br />Staff recommends that the Subdivision Committee approve the Tentative Parcel Map, <br />subject to the findings and conditions of approval. <br />Seth Adams, Associate Planner <br />ATTACHMENTS <br />1.
