6.2.A. - Page 1 <br />REPORT <br />To the Honorable Mayor and City Council <br />From the City Manager <br />August 27, 2018 <br />SUBJECT <br />Final Acceptance — 275 Oracle Parkway <br />RECOMMENDATION <br />By Motion, accept the construction improvements for 275 Oracle Parkway, and <br />authorize the release of the bonds in accordance with the Subdivision Improvement <br />Agreement. <br />BACKGROUND <br />On June 27, 2016 the City Council approved the Improvement Agreement for the 275 <br />Oracle Parkway Development which consisted of the creation of a two-story, 64,000 <br />square foot high school for Design Tech. The Construction Permit, approved and issued <br />by the City, required the developer to make on-site and off-site improvements. <br />Improvements include but are not limited to new domestic and recycled water services, <br />storm drain connections, sanitary sewer services, levee improvements, and improved <br />connections and facilities for the Bay Trail. The total value of completed improvements <br />is estimated at $2,190,387.00. <br />As part of the conditions of approval, the project was required to enter into a revocable <br />encroachment permit for private utilities crossing the public right-of-way of Oracle <br />Parkway. Oracle Parkway does not have a sewer main or domestic water main within <br />the public right-of-way, and the closest publicly available facilities are in Marine <br />Parkway. The only feasible option was to allow the private utilities to have crossings <br />through Oracle Parkway to connect into the private system within the Oracle Campus. <br />The attached revocable encroachment permit allows the City to remove these facilities if <br />needed, and adequately protects the City by requiring insurance and bonding to be <br />provided for the facilities as long as they remain in place. <br />ANALYSIS <br />The developers, Centrum Owners Association and Oracle America, Inc., have <br />completed the construction of improvements in accordance with the Agreement, the <br />plans and specifications, the conditions of approval and tentative map, and to the <br />satisfaction of the City's Engineering and Transportation Division. <br />
