<br />10. <br /> <br />of potential cable Subscribers because of the income of the residents of the potential <br />cable Subscribers or the area in which such group resides. <br /> <br />Written Notice. All notices, reports or demands required to be given under this Franchise <br />shall be in writing and shall be deemed to be given I) upon delivery if delivered <br />personally to the Person designated below, or 2) on the fifth day following deposit in the <br />United States mail, or 3) on the next business day if sent by express mail or overnight air <br />courier addressed to the party to which notice is being given, or 4) upon acceptance if <br />sent via registered or certified mail, postage prepaid thereon. <br /> <br />If to City: <br /> <br />City Manager <br />1017 Middlefield <br />Redwood City, California 94063 <br /> <br />If to Grantee: <br /> <br />Director, Government Affairs and Franchising <br />West Bay Area Division <br />Comcast of California IX, Inc. <br />1205 Chrysler Drive <br />Menlo Park, California 94025 <br /> <br />Such addresses may be changed by either party upon notice to the other party given as <br />provided in this section. <br /> <br />11. <br /> <br />1. <br /> <br />Ownership of Grantee. Grantee shall provide and maintain a true and correct copy of <br />Grantee's basic organizational structure which shall be attached hereto as Exhibit A. <br /> <br />SECTION 3. <br />CONSTRUCTION STANDARDS <br /> <br />Registration. Permits. Construction Codes. and Cooperation. <br /> <br />a. <br /> <br />Grantee shall comply with the construction requirements of Applicable Laws. <br /> <br />b. <br /> <br />Grantee agrees to obtain a permit as required by City prior to removing, <br />abandoning, relocating or reconstructing, if necessary, any portion of its facilities. <br />Notwithstanding the foregoing, City understands and acknowledges there may be <br />instances when Grantee is required to make repairs, in compliance with <br />Applicable Laws, that are of an emergency nature. Grantee will notify City prior <br />to such repairs, if practicable, and must obtain the necessary permits in <br />accordance with the City's general permitting practices in a reasonable time after <br />notification to City. <br /> <br />c. <br /> <br />Reimbursement, including Nondiscriminatory permit fees and charges, paid <br />through the permitting process is separate, and in addition to, any other fees <br />included in the Franchise. Grantee, at the time of or prior to applying for permits, <br />shall provide City with a description of the facility to be provided by the Grantee <br />in sufficient detail for City to determine compliance with the Franchise and <br />Applicable Laws. <br /> <br />8 <br />
