City and Grantee shall arrange <br />such special testing so as to minimize hardship or inconvenience to the <br />Subscribers caused by such testing. <br /> <br />b. <br /> <br />Before requesting such tests, Grantee shall be afforded due process to investigate <br />any potential noncompliance, and at least thirty (30) days advance written notice. <br />City shall meet with Grantee prior to requiring special tests to discuss the need for <br />such and, if possible, visually inspect those locations which may be the focus of <br />concern. Grantee shall participate and cooperate in such testing and shall not <br />assess City or Subscribers any additional fees or costs associated with time or <br />labor Grantee may incur as a result of its participation in such testing. If such <br />special testing establishes that the System meets all required FCC technical <br />standards set forth at Section 4.4, the City shall bear the expense for such special <br />testing. If such special testing establishes that the System does not meet all <br />required FCC technical standards set forth at Section 4.4, Grantee shall bear the <br />expense for such special testing. <br /> <br />FCC Reports. The results of any tests required to be filed by Grantee with the FCC shall <br />also be filed with City or its designee within ten (10) days of the City's written request of <br />such test results. <br /> <br />Line Extension. <br /> <br />a. <br /> <br />Grantee shall design and construct the Cable System in such a manner as to have <br />the capability to pass by every single-family dwelling unit, multiple-family <br />dwelling unit within the Franchise Area. <br /> <br />b. <br /> <br />Except as provided in Section 6.3 and Exhibit B-I herein, any unit located within <br />one hundred twenty-five (125) feet of the nearest tap on Grantee's System shall <br />be connected to the System at no charge other than the Standard Installation <br />charge. Grantee shall, upon request by any potential Subscriber in the City <br />beyond the one hundred twenty-five (125) foot limit, extend Service to such <br />Subscriber provided that the Subscriber shall pay the net additional costs. <br /> <br />Lockout Device. Upon the request of a Subscriber, Grantee shall make available by sale <br />or lease a Lockout Device allowing Channels on the System to be blocked. <br /> <br />SECTION 5. <br />SERVICE PROVISIONS <br /> <br />Regulation of Service Rates. <br /> <br />a. <br /> <br />City may regulate rates for the provision of Cable Service, equipment, or any <br />other Cable Service provided over the System in accordance with applicable <br />federal law, in particular 47 C.F.R. Part 76 subpart N. In the event the City <br />chooses to regulate rates it shall, in accordance with 47 C.F.R. § 76.910, obtain <br />certification from the FCC, if applicable. The City shall follow all applicable <br />FCC rate regulations and shall ensure that appropriate personnel are in place to <br /> <br />15 <br />
