<br />v. <br /> <br />V1. <br /> <br />Vll. <br /> <br />Vl1l. <br /> <br />All reports required under this Franchise, except those required by law to <br />be kept confidential, shall be available for public inspection in the City's <br />offices during Normal Business Hours. <br /> <br />All reports and records required to be delivered to City under this <br />Franchise shall be furnished at the sole expense of Grantee. <br /> <br />The willful refusal, failure, or willful negligence of Grantee to file any of <br />the reports required as and when due under this Franchise, may be deemed <br />a material breach of this Franchise if such reports are not provided to City <br />within thirty (30) days after written request therefor, and may subject the <br />Grantee to all remedies, legal or equitable, which are available to City <br />under this Franchise. <br /> <br />Any materially false or misleading statement or representation made <br />knowingly and willfully by the Grantee in any report required under this <br />Franchise may be deemed a material breach of the Franchise and may <br />subject Grantee to all remedies, legal or equitable, which are available to <br />City. <br /> <br />SECTION 6. <br />ACCESS CHANNEL(S) PROVISIONS <br /> <br />PEG Access Facilities. The Grantee shall provide resources for PEG Access Facilities <br />including Channel capacity, funding, necessary interface equipment and cabling to permit <br />operation as specified herein in Exhibit B. <br /> <br />1. <br /> <br />2. <br /> <br />Fiber Agreement. The Grantee shall provide the Fiber Network as specified in Exhibits <br />B and F. <br /> <br />PEG Access Facility Management Entity. The City may delegate the responsibility for <br />PEG access facility management to an entity that it designates or establishes, not limited <br />to, but including PEN-TV and/or SAMCAT. <br /> <br />3. <br /> <br />4. <br /> <br />Drops to Designated Buildings. <br /> <br />Grantee shall provide free of charge throughout the term of this Franchise, <br />Installation of one (1) network Drop to a demarcation point within the location, <br />one (1) cable outlet, one (1) Converter, if necessary to receive standard cable, and <br />standard cable which consists of Basic Cable Service and expanded basic cable <br />service consisting of approximately seventy (70) channels or its future equivalent, <br />excluding pay-per-view, pay-per-channel (premium) programming offered by <br />Grantee, without charge to all the locations identified on Exhibit B-1 attached <br />hereto and made a part hereof, and such other public locations, including state <br />accredited public schools within two hundred (200) feet of Grantee's existing <br />cable plant, and subsequently designated by City as determined in City's sole <br />discretion. <br /> <br />a. <br /> <br />25 <br /> <br />
