<br />7B <br />Page 4 <br /> <br />RESOLUTION NO. <br /> <br />APPROVE A BUDGET AMENDMENT OF $1,000,000 FROM THE CAPITAL PROJECT <br />FUND (CPF) TO THE COURTHOUSE SQUARE PROJECT BUDGET <br /> <br />WHEREAS, on March 14,2005, the City Council approved the Agreement with <br /> <br />DPR Construction Inc. (Agreement) for At-Risk Construction Management <br /> <br />Services/General Contractor Services during Construction of the Historic Courthouse <br /> <br />Reconstruction for a Final Agreed Price (FAP) of Four Million Nine Hundred Fifty Five <br /> <br />Thousand and Fifty Seven and No/100 Dollars ($4,955,057.00); and <br /> <br />WHEREAS, in the March 14, 2005 staff report, Phase II - The Courthouse <br /> <br />Square could not be bid until complete plans and specifications were submitted by the <br /> <br />Urban Design Team of Freedman, Tung & Bottomley (FTB), and on February 16, 2006, <br /> <br />FTB submitted their plans for bidding; and <br /> <br />WHEREAS, the "Final Agreed Price" to complete Phase II, Courthouse Square <br /> <br />is Five Million Four Hundred Ten Thousand Two Hundred Ninety One and No/100 <br /> <br />Dollars ($5,410, 291.00); and <br /> <br />WHEREAS, Amendment No.1 to the Agreement requires approval of this <br /> <br />additional $5,410,291.00, and <br /> <br />WHEREAS, funds in the amount of Three Million Dollars ($3,000,000.00) were <br />appropriated in the FY 05-05 CPF for a downtown plaza/public space to fund the <br /> <br />Courthouse Square Project; and <br /> <br />WHEREAS, funds in the amount of One Million Dollars ($1,000,000.00) are <br /> <br />available from the Capital Project Fund Contingency Account to fund the Courthouse <br /> <br />Square Project; and <br /> <br />Atty/Reso/Reso.1602 <br />030806 <br /> <br />- ---- -.-- n. .- <br />
