6.10
Page 1

REPORT

To the Honorable Mayor and City Council
From the Ci Mana er

March 13, 2006

Subject
Amendment No.2 to the Consultant Agreement with Chaudhary and Associates, Inc.
relating to the Ralston Avenue/Marine Parkway/Route 101 Interchange Reconfiguration
Project.

Recommendation
By motion, approve Amendment No.2 to the agreement with Chaudhary and
Associates, Inc., for providing supplemental construction survey and other support for
the Ralston Avenue/Marine Parkway/Route 101 Interchange Reconfiguration Project, in
an amount not-to-exceed $22,274.73.

Background
On December 13, 2004, the City Council approved and authorized the execution of an
agreement with Chaudhary and Associated ("Chaudhary"), for providing surveying and
related support for the Ralston Avenue/Marine Parkway/Route 101 Interchange
Reconfìguration Project, in an amount not-to-exceed $95,877.60. Amendment No.1 to
this contract was approved on June 20, 2005, adding $75,000 to the contract.

In accordance to the Standard Specifications, the Contractor has a right to request
surveying services to locate everything that he has to build. The level of services that
contractors request for this service varies, depending on the complexity of the job and
the contractor's willingness to take on more liability for laying out the project. In this
case, due to difficult conditions, the Contractor has requested the maximum possible
surveying services, driving the cost beyond what could have been expected.

The project is substantially complete, and even more surveying services were
requested than was anticipated at the time Amendment No.1 was approved.
Chaudhary is requesting an additional $22,274.73 to complete the project. This will put
the overall fees to Chaudhary for surveying to $193,152.33. This ratio is on the high
side, but still acceptable for such a complex highway project involving bridges.

Alternative
Council can choose not to approve Amendment No.2 to this contract, which will delay
the completion of construction and, subsequently, a delay in project delivery.

._... .._- .-.. _. ....
