These total fees were
separated into three phases: pre-bid/value engineering, pre-construction services, and
construction management/contract administration. Since the fees for this agreement
are large, they were released in three stages according to the tasks. Therefore, three
previous amendments were issued, Amendment No.3 also added $280,226.91 to the
contract to cover the unanticipated difficulties during the construction of this project.

Amendment No.4 for the agreement with Harris & Associates is necessary in order to
wrap up the post construction management of this project.

The construction portion of this project is substantially complete. Only minor fencing
and punchlist items remain outstanding. The budget for Harris is exhausted; however,
tasks such as: claim resolution, quantity reconciliation, delay and schedule settlement,
and the final acceptance of the improvements by Caltrans, remain to be done. This
amendment will fund such activities, and close out the project for delivery to Caltrans.

Alternative
Council can choose to not approve this Amendment. However, this will derail the timely
delivery of the project.

~--- --~~~..._. ...-.--

._.. --... -. .....

._.._----~ -
