8/27/2018 <br />WHEREAS, the proposed amendments to Article 59 of the Zoning Ordinance <br />would allow for delivery centers and indoor nurseries with a 600 ft. buffer from protected <br />uses in the Commercial Office (CO) Zoning District with a Use Permit (the "Zoning <br />Ordinance Amendment'); and <br />WHEREAS, on June 5, 2018, the Planning Commission recommended the <br />proposed Zoning Ordinance Amendment; and <br />WHEREAS, the City Council is the decision-making body for this Zoning <br />Ordinance Amendment; and <br />WHEREAS, on June 25, 2018, the City Council held a duly -noticed public <br />hearing on the proposed Zoning Ordinance Amendment and on said date the public <br />hearing was opened, held, and closed and all interested members of the public were <br />afforded an opportunity to be heard; and <br />WHEREAS, at the public hearing the City Council considered the staff reports, <br />oral and written, and testimony and materials presented by all those wishing to be <br />heard on the Zoning Ordinance Amendment; and <br />WHEREAS, the City Council has reviewed and considered the exemption <br />determination under the California Environmental Quality Act ("CEQA") prior to taking <br />any approval actions on this Zoning Ordinance Amendment and approves such <br />exemption. <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF REDWOOD CITY <br />DOES ORDAIN AS FOLLOWS: <br />Section 1. The recitals set forth above are true and correct, and are hereby <br />incorporated herein by this reference as if fully set forth in their entirety. <br />Section 2. The City Council hereby finds that the proposed Zoning Ordinance <br />Amendment is in the public interest. <br />Section 3. This proposed Zoning Ordinance Amendment has been reviewed <br />with respect to applicability of the California Environmental Quality Act ("CEQA") and <br />the State CEQA Guidelines (California Code of Regulations, Title 14, Sections 15000 et <br />seq.). The proposed ordinance is statutorily exempt from the requirements of CEQA <br />under Business and Professions Code Section 26055(h), which states that CEQA does <br />not apply to the adoption of an ordinance, rule or regulation by a local jurisdiction that <br />requires discretionary review and approval of other permits or licenses, as described in <br />the staff report. The uses described in the Zoning Ordinance Amendment shall require <br />a Use Permit. Pursuant to CEQA Guidelines Section 15091(e), the documents and <br />other materials that constitute the record of proceedings upon which the City Council <br />has based its decision are located in and may be obtained from the Office of the City <br />ATTY/ORD.471/RC AMENDING ARTICLE 59 OF ZA ORD COMMERCIAL CANNABIS ORDINANCE NO. 1130-376 <br />REV: 06-12-18 MI MUFF NO. 301 <br />Page 2 of 7 <br />
