Code § 27383, <br />IMPROVEMENT AGREEMENT <br />Btu Harbor —I Uccelli Boulevard <br />THIS IMPROVEMENT AGREEMENT ("Agreement") is madc and entered into on this" day of_ <br />, 20 ("Effective Date") by and between by and between RWC HARBOR <br />CO TI <br />ES, LC, a Delaware limited liability company ("Developer"), and the CITY OF <br />RED O ITY, a charter city and California minlicipal corporation ("City„) with reference <br />to the fol owing facts: <br />RECITALS <br />A , Developer is the Current fee owner of that certain real property consisting of <br />approximately 13.21 acres located within the City of Redwood City, County of San Mateo, State of <br />California, described in Exhibit A, attached hereto and incorporated herein by reference (the "Property"). <br />D . On February 4, 2014, the [Tanning Commission of the City of Redwood City adopted, <br />among other approvals, Resolution No. 14-02, approving the Vesting Tentative Map TM2012-02 for 411 <br />residential units ("Project"), prepared by Sandis and dated July 7, 2013 ("'Tentative Map"), subject to <br />certain conditions of approval ("Conditions"). <br />C . The Conditions require either (1) that certain public improvements for the Project be <br />constructed prior to approval of the final map ("Final Map"), or (2) that Developer enter into an <br />agreement with City providing for the future construction of such public improvements. <br />D . Developer has submitted the Final Map and applied to City for Final Map approval <br />Without having completed the required public improvements and, therefore, will enter into an agreement <br />with City providing for the fixture construction and installation of such public improvements, as required <br />by Government Code section 66462(a)(1). <br />E. Developer has submitted to City plans, specifications and drawings entitled Bill Harbor <br />Residential Community Onsite Improvement Plans and Bair Island Road/Uccelli Boulevard Blu Harbor <br />Offsite Improvements, prepared by Saudis and dated May 22, 2015 (the "Improvement Plans"), which, in <br />addition to other improvements, provide for certain on-site public improvements consisting of street and <br />street light improvements, storm drain systems, domestic water systems and sanitary sewer systems for <br />the Project (collectively, "Improvements"). <br />F. Upon approval and recordation of the Final Map, the Property will be divided into four <br />hundred two residential condominium units hereinafter referred to as the "Residential Parcels", and <br />three common area spaces hereinafter referred to as the "Open Space Parcels". <br />REV; 06-04.15 VR <br />Page 1 of 20 <br />ATTY/AGR.2015.1151Blu Harbor <br />
