paragraph, covered persons includes any person who is an employee, agent, consultant, <br />officer, or elected or appointed official of the City or Subrecipient. Subrecipient will <br />incorporate in all subcontracts hereunder a provision prohibiting such interest. <br />22. LOBBYING PROHIBITED. Funds provided under this Agreement will not be <br />used by Subrecipient for publicity or propaganda purposes designed to support or defeat <br />legislation pending before federal, state, or local government. <br />23. INHERENTLY RELIGIOUS ACTIVITY PROHIBITED. There will be no <br />religious worship, instruction, or proselytizing as part of the Project or services funded <br />under this Agreement. <br />The following restrictions and limitations will apply to the services rendered by <br />Subrecipient in connection with the terms of this Agreement: <br />a) Subrecipient will not discriminate against any employee or applicant for <br />employment on the basis of religion and will not limit employment or give preference in <br />employment to persons on the basis of religion; and <br />b) Subrecipient will provide no religious instruction or counseling, conduct no <br />religious worship or services, engage in no religious proselytizing, and exert no other <br />religious influence related to the Project. <br />24. COMPLIANCE WITH CALIFORNIA LABOR LAWS AND FEDERAL <br />REQUIREMENTS. The Subrecipient agrees to comply with the requirements of the <br />Secretary of Labor in accordance with the Davis -Bacon Act, as amended, the provisions <br />of the Contract Work Hours and Safety Standards Act (40 U.S.C. 3701 et seq.) and all <br />other applicable federal, state and local laws and regulations pertaining to labor standards <br />insofar as those acts apply to the performance of this Agreement. Subrecipient agrees to <br />comply with the Copeland Anti -Kickback Act (18 U.S.C. 874, 40 U.S.C. 3145) and its <br />implementing regulations of the U.S. Department of Labor at 29 CFR Part 3. <br />Subrecipient agrees that, pursuant to 42 U.S.C. 5310, all laborers and mechanics <br />employed by contractors or subcontractors in the performance of construction work <br />ATTY/AGR/2018.176/PROJECT SENTINEL - CDBG <br />REV: 08-07-18 DZ <br />Page 12 of 17 <br />
