<br />8A <br />Page 3 <br /> <br />range of economic resources than constructing new buildings, may also help to avoid <br />the environmental impacts and energy consumption associated with building demolition <br />and new construction. <br /> <br />Based on the analysis presented in this report, staff belíeves it would be consistent with <br />City goals and policies to delete the requirement that existing structures must have <br />been occupied within the past three years to receive a credit for prior use in determining <br />Transportation Impact Fee payment, and such action would not affect the overall <br />integrity of the fee program. The Ordinance amendment currently being recommended <br />would delete this vacancy time limit for credits. <br /> <br />The proposed amendment reads as follows: <br /> <br />Section 18.249 C. Calculation of Fee Credit for Existing Uses <br /> <br />18.249 C. 1. For a Development that involves a change in land use, <br />credit for the existing uses shall be determined by the Administrator <br />based on the level of utilization and actual or estimated PM Peak Hour <br />Trips generated by the existing use. The credit shall not necessarily be <br />equivalent to the amount of the I mpact Fee based on the existing uses <br />but calculated with reference to the then current Impact Fee Schedule. <br />The Administrator may require the Applicant to bear the cost of existing <br />PM Peak Hour traffic counts. If a Development includes existing, <br />unoccupied, or unused buildings or structures, the credit may be based <br />upon the estimated PM Peak Hour Trips generated by the prior permitted <br />use and occupancy of the structures at the site of the proposed <br />development. within the past three ye3rs. Developments including <br />buildings or structures that h3vo been V3c3nt or not used for more than <br />throe ye3rs shall not receive :my credit. <br /> <br />It should also be noted that revisions to the transportation project list and the fee <br />structure of the Transportation Impact Fee Program are currently being developed. The <br />updated fee structure will be completed in 2006. <br /> <br />Alternatives <br />1. Do not amend the Ordinance; retain the three-year vacancy limit for credits. <br /> <br />2. Increase the vacancy time limit to allow a longer duration for credits to apply. <br /> <br />3. No action at this time, pending the findings of the updated Transportation Impact <br />Fee Study. <br /> <br />4. For applicants seeking approvals at the time this action is considered, the City <br />Council may wish to explore with the applicant some form of agreement that <br />would allow partial payment of the required impact fee in exchange for receiving <br />their requested permits. <br /> <br />Page 3 of 4 <br />
