Code § 27383. <br />DEMOLITION AGREEMENT <br />REMOVAL OF TOWER AND OAK MEDICAL OFFICE BUILDINGS at KAISER <br />PERMANENTE REDWOOD CITY MEDICAL CENTER <br />THIS DEMOLITION AGREEMENT ("Agreement") is made and entered into on this _ day of <br />, 2018 ("Effective Date") by and between KAISER FOUNDATION HOSPITALS, a <br />California public benefit non-profit corporation ("Developer"), and the CITY OF REDWOOD CITY, a <br />charter city and California municipal corporation ("City") with reference to the following facts: <br />RECITALS <br />A. Developer is the current fee owner of that certain real property consisting of <br />approximately 8_3 acres located within the City of Redwood City, County of San Mateo, State of <br />California, described in Exhibit A, attached hereto and incorporated herein by reference (the "Property"). <br />B. On February 6, 2018, the Planning Commission of the City of Redwood City adopted, <br />among other approvals, Resolution No. 18-01, approving the Planned Community Permit and Planned <br />Development Permit for the construction of Medical Office Building 2 ("MOB2") and the demolition of <br />the existing Tower Medical Office Building ("Tower MOB") and Oak Medical Office Building ("Oak <br />MOB"), subject to certain conditions of approval ("Conditions") (collectively the "Project"). <br />C. The California Health and Safety Code grants the Office of Statewide Health Planning <br />and Development ("OSHPD") the authority to enforce building standards in the context of construction <br />and alteration of "hospital buildings," as that term is defined by H&S Code section 129725. The Tower <br />MOB is a "hospital building" pursuant to H&S Code section 129725. For this reason, OSHPD will <br />permit, oversee, and inspect the demolition of the Tower MOB ("Tower MOB Demolition"), while the <br />City will permit, oversee, and inspect the demolition of the Oak MOB ("Oak MOB Demolition") <br />(collectively, "Demolition Work"). <br />D. The Project phasing requires the temporary occupancy of MOB2 prior to the Demolition <br />Work in order to provide a space for the service providers and equipment while the Demolition Work is <br />being completed. <br />E. Tinning of the Demolition Work is of the essence, as the Project is not building adequate <br />parking to support the Tower MOB and Oak MOB in addition to MOB2.
