Code § 27383. <br />AMENDED AND RESTATED <br />LANDSCAPE MAINTENANCE AGREEMENT <br />(Kaiser Permanente Redwood City Medical Center) <br />THIS LANDSCAPE MAINTENANCE AGREEMENT ("Agreement") is made and entered into <br />this _ day of , 2018 ("Effective Date"), by and between KAISER FOUNDATION <br />HOSPITALS, a California nonprofit public benefit corporation ("Developer"), and the CITY OF <br />REDWOOD CITY, a charter city and California municipal corporation ("City") with reference to the <br />following facts: <br />RECITALS <br />A. Developer and City entered into that certain Landscape Maintenance Agreement dated <br />July 31, 2014, and recorded August 1, 2014 as Instrument Number 2014-069042, in the Official Records <br />of the County of San Mateo ("Original Agreement"). <br />B. Developer and City have agreed that the Original Agreement be amended and restated to <br />include additional landscaping not included in the Original Agreement. <br />C. Reference is made to that certain real property situated in the City of Redwood City, <br />County of San Mateo, State of California, known as the _Redwood City Medical Center, 1100 Veterans <br />Blvd., Redwood City, CA 94063, and described on Exhibit "A", attached hereto and incorporated by this <br />reference as if fully set forth herein (the "Property"). The Property is being developed as a medical <br />services project. <br />D. In connection with its development of the Property as a medical services project, the <br />Developer submitted to the City plans, which include, inter alia, landscaping plans for along the Property <br />frontage ("Plans"), all of which Plans have been approved by the City. The Plans provide for installation <br />of certain landscaping, pedestrian lighting, and irrigation ("Improvements") within Veterans Boulevard, <br />Walnut Street, Bradford Street, Marshall Street, Marshall Court, and Maple Street ("Maintenance Area") <br />as the Improvements and Maintenance Area are more specifically shown on Exhibit "B" attached hereto <br />and by this reference made a part hereof. <br />E.
