Code § 27383. <br />AMENDED AND RESTATED <br />STORMWATER TREATMENT MEASURES <br />MAINTENANCE AGREEMENT <br />Kaiser Permanente Redwood City Medical Center <br />1100 Veterans Blvd. <br />Redwood City, CA 94063-2026 <br />THIS AMENDED AND RESTATED STORMWATER TREATMENT MEASURES <br />MAINTENANCE AGREEMENT ("Agreement") is made and entered into <br />,20 — <br />20_ ("Effective Date"), by and between the City of Redwood City ("City") and <br />Kaiser Foundation Hospitals, a Califomia nonprofit public benefit corporation ("Property <br />Owner"). <br />RECITALS <br />A. Property Owner and City entered into that certain Stormwater Treatment <br />Measures Maintenance Agreement dated July 31, 2014, and recorded August 1, 2014 as <br />Instrument Number 2014-069041, in the Official Records of the County of San Mateo <br />("Original Agreement"); and <br />B. Property Owner and City have agreed that the Original Agreement be <br />amended and restated to include additional stormwater treatment measures not included <br />in the Original Agreement; and <br />C. On November 19, 2015, the California Regional Water Quality Control <br />Board, San Francisco Bay Region, adopted Order R2-2015-0049, issuing Waste <br />Discharge Requirements and National Pollutant Discharge Elimination System Permit No. <br />CAS612008 (the "NPDES Permit"); and <br />D. Provision C.3. of the NPDES Permit, as it may be amended or reissued from <br />time to time, requires the permittee public agencies to provide minimum verification and <br />access assurances that all treatment measures shall be adequately operated and <br />maintained by entities responsible for the stormwater treatment measures; and <br />E. The Property Owner is the owner of real property commonly known as <br />Kaiser Redwood City Medical Center, 1100 Veterans Blvd, Redwood City, CA 94063 (the <br />"Property"), as more particularly described in Exhibit "A', attached hereto and incorporated <br />Page 1 of 24 <br />REV: 08-17-18 PR <br />ATTYIAGR.2018.195/Kaiser M0132 - STMMA <br />
