that are damaged by City and its agents. <br />b. In the event any stop payment notices are filed with the City or mechanics’ <br />liens are placed on the property in connection with the construction of the Stormwater <br />Treatment Measures, the City will promptly respond to said notices or liens in accordance <br />with applicable law at City’s sole expense, and will indemnify, defend, protect and hold <br />Property Owner harmless from and against all such claims. <br />3. Access License. City is granted an access license under this Agreement for purposes <br />of constructing the Stormwater Treatment Measures at the site, in accordance with the <br />specifications, and for access and inspection purposes as set forth in this Agreement and as <br />required by the Permit. All work performed by the City shall be at no cost to Property Owner. <br />4. Insurance. City shall require all contractors and subcontractors (collectively, <br />“Contractor”) performing construction services (“Services”) in connection with the Stormwater <br />Treatment Measures to procure and maintain at all times the following insurance coverage <br />types with minimum limits equal to the amount indicated below and in compliance with the <br />terms below. <br /> <br />Type of Coverage Minimum <br />Requirement <br />Commercial General Liability Insurance, including Bodily Injury, Personal <br />Injury, Property Damage, Advertising Injury, and Medical Payments <br />Each Occurrence <br />General Aggregate <br /> <br /> <br />$ 2,000,000 <br />$ 4,000,000 <br />Automobile Liability Insurance - Any Auto <br />Each Occurrence <br />General Aggregate <br /> <br />$ 1,000,000 <br />$ 2,000,000 <br /> <br />a. Commercial General Liability and Automobile Liability Insurance. Commercial <br />General Liability Insurance and Any Auto Automobile Liability Insurance that shall protect the <br />Contractor, the Property Owner and the City from all claims of bodily injury, property damage, <br />personal injury, death, advertising injury, and medical payments arising from performing any <br />portion of the Services. (Form CG 0001 and CA 0001, or forms substantially similar, if <br />approved by the Property Owner.) <br /> <br />b. Proof of Insurance. The Contractor shall not commence performing any <br />portion of the Services until all required insurance has been obtained and certificates <br />indicating the required coverage have been delivered in duplicate to the Property Owner and <br />approved by the Property Owner. Certificates and insurance policies shall include the <br />following: <br /> <br />i. Policies shall not be canceled until notice has been mailed to the <br />Property Owner, stating date of cancellation. Date of cancellation shall <br />not be less than thirty (30) days after date of mailing notice. <br /> <br />ii.
