REV: 03-23-22 RL <br />shall mean the remaining Premises, consisting of approximately 6,390 square feet of area, <br />depicted in Exhibit A as the “Remaining Premises” and the Temporary Bike & Pedestrian <br />Access as the temporary bike path is depicted in the Project’s Construction Management Plan <br />(“Remaining Premises”). With regard to the Excluded Premises, both parties acknowledge and <br />agree that Section 8, requiring the City to return the Premises to Owner in the same condition as the <br />condition that was turned over to the City, ordinary wear and tear excepted, free of the Sublicenses <br />and Boatowners, applies. This Amendment shall serve as the 30-day notice, and City shall have 30 <br />days from the Amendment Commencement Date to deliver the Excluded Premises to Owner. <br />2. Extension of Term. The Term of the Agreement as set forth in Section 5 thereof <br />is hereby extended for the Remaining Premises as a month-to-month license expiring thirty (30) <br />days after Owner’s written notice to City of termination but in no event later than January 1, <br />2023. <br />3. Agreement in Effect. Owner and City acknowledge and agree that the Agreement, <br />except as amended by this Third Amendment, remains in full force and effect in accordance with <br />its terms. <br />4. Electronic Signatures. If both Owner and City agree, electronic signatures may <br />be used in place of original signatures on this Third Amendment. Owner and City intend to be <br />bound by the signatures on the electronic document, is aware that the other party will rely on the <br />electronic signatures, and hereby waives any defenses to the enforcement of the terms of this <br />Third Amendment based on the use of an electronic signature. After Owner and City agree to the <br />use of electronic signatures, Owner and City must each sign the document electronically. <br />IN WITNESS WHEREOF, the parties have executed this Third Amendment the day and <br />year first above written. <br />[The remainder of this page left intentionally blank] <br />ATTY/AGR.2022 - Amend.
