payment of such additional sum or sums for the services provided by City, if any, within thirty (30) days <br />after billing by City of the additional sum to be paid and agrees that the amount payable shall be increased <br />by ten percent (10 %) in the event payment is not made within such thirty (30) day period. Any part of the <br />Deposit or such additional sum or sums not utilized by City shall be returned promptly to Developer. <br />11. Completion of Work. After Developer (a) completes the Work in accordance with the <br />Improvement Plans and the terms and conditions of this Agreement, (b) repairs any private or public <br />property damaged as a result of the Work or pays the full cost of such repair to the owner whose property <br />was damaged and (c) obtains the written acceptance of such repair or payment from any owner whose <br />private property was repaired by Developer or to whom Developer paid the full cost of such repair, <br />Developer will provide City with a written notice of completion, together with copies of all written <br />acceptances. <br />12. Facilities Fee Credit <br />121 Pursuant to Redwood City Code section 38.14, Developer is required to pay the <br />Facilities Fee to provide for the use and construction of existing and future water system capital <br />facilities in accordance with a capital improvement program duly approved by the City Council. <br />122 Developer, as a condition of approval for the Project, is required to construct and <br />install the FF Eligible Improvements. In consideration for Developer's agreement to construct <br />and install such FF Eligible Improvements, Developer, subject to the terms of this Section 12, <br />will be entitled to a partial credit against the Facilities Fee otherwise due in connection with the <br />project. <br />123 Developer shall receive a provisional facilities fee credit of one hundred percent <br />(100 %) of the Estimated Cost of the FF Work ("Provisional FF Credit ") at the time the Facilities <br />Fee is due under Redwood City Code Section 38.14.A, except that such Provisional FF Credit <br />shall not exceed the actual amount of Facilities Fee due, or Seventy-Six Thousand Eight Hundred <br />Forty -One and No /100 ($76,841.00), whichever is smaller. <br />12 A Promptly following the substantial completion of the FF Eligible Improvements, <br />Developer shall submit to City's Director of Community Development a post - completion <br />accounting report for purposes of calculating the final facilities fee credit ( "Actual FF Credit "). <br />The post-completion accounting report, including supporting documentation, must be received by <br />City prior to the date on which the City Council accepts the applicable FF Eligible Improvements <br />pursuant to Section 13.1 of this Agreement. The post - completion accounting report shall: <br />12.4.1. Describe with particularity each of the FF Eligible Improvements (or <br />portion thereof) for which Developer has received a Provisional FF Credit; <br />and <br />12.4.2. Set forth by line item Developer's actual out -of- pocket costs paid to <br />unaffiliated third parties, including but not limited to Developer's <br />contractors and subcontractors, in connection with the construction and <br />installation of each of the applicable FF Eligible Improvements (or portion <br />thereof) ("Eligible FF Work Costs "). Internal project management and <br />administrative costs and expenses, including amounts paid to affiliates of <br />Developer, if any, shall not be considered Eligible FF Work Costs and shall <br />not be counted for purposes of calculating the Actual FF Work Credit; and <br />REV: 08 -24-18 PR <br />Page 5 of 24 <br />ATTY /AGR.2018.202 /Kaiser MOB2 - IA <br />
