B. - Page 26 <br />ORIGINAL <br />RESOLUTION NO. 15034 <br />07/12/2010 <br />RESOLUTION OF THE COUNCIL OF THE CITY OF REDWOOD CITY <br />SUMMARILY VACATING A PORTION OF RIGHT-OF-WAY AND <br />RESERVING AN EASEMENT; DIRECTING THE CITY CLERK TO <br />ACCEPT THE GRANT DEEDS IN EXCHANGE THEREFOR; AND TO <br />FILE SAID DEEDS FOR RECORDATION <br />(WINSLOW STREET REALIGNMENT) <br />WHEREAS, pursuant to the provisions of Chapter 4 (commencing with §8330), <br />Part 3, Division 9 of the Streets and Highways Code of the State of California, this <br />Council may summarily vacate right-of-way and easements, if such right-of-way and <br />easements have been superseded by relocation; and <br />WHEREAS, the rights-of-way as shown on Exhibit "B, & C" hereof, attached <br />hereto and by this reference incorporated herein, are no longer required for public uses <br />provided that said rights-of-way is relocated; and <br />WHEREAS, the City is willing to reserve a 20' wide easement for a PG&E high <br />pressure gas line, as depicted on Exhibit "B" hereof; and <br />WHEREAS, the County of San Mateo County proposes to convey to the City of <br />Redwood City the grant deed and grant of easement deed shown in Exhibit "D", in <br />exchange for the right-of-way to be vacated; and <br />WHEREAS, the value of the property interest to be received by the City pursuant <br />to said exchange equals or exceeds the value of the property interest to be vacated; <br />NOW, THEREFORE, BE IT RESOLVED, BY THE CITY COUNCIL OF <br />THE CITY OF REDWOOD CITY AS FOLLOWS: <br />1. This Council hereby finds that those certain rights-of-way shown on Exhibits <br />"B, & C," with the designation, "City's Grant of Portion of Winslow Street to County of <br />San Mateo" have been superseded by relocation, and said right-of-way shall be, and <br />are hereby ordered, vacated. <br />2. This Council hereby reserves a 20' -wide easement for PG&E gas line <br />facilities, and depicted on Exhibit "B" with the designation, "20' -Wide PG&E Gas Line <br />Easement". <br />3. The City Clerk is hereby authorized and directed to accept, on behalf of the <br />City, the grant deeds and easement deed from the County (in the form approved by the <br />ATTY/RES0.2024 #15034 <br />062210 MUFF # 608 <br />
