August 21, 2002 <br /> <br /> City of Redwood City <br /> City Clerk <br /> 1017 Middlefield Road <br /> Redwood City, California 94064 <br /> <br /> Re: Finding of Zoning Non=Conformance <br /> <br /> Dear Sir or Madam: <br /> <br /> Please be advised that Innovations - Successful Salon Services, Inc. (hereinafter <br /> "Innovations") hereby notices the City of Redwood City that it is appealing the <br /> "zoning ordinance decision" denying the use of the property located at 2652 <br /> Broadway, Redwood City, California (hereinafter the "Property"), for a store with <br /> pr/madly retail sales of professional beauty products to be operated by Innovations <br /> under its Cosm6Prof~ logo. The Community Development Services Department's <br /> (hereinafter, the "Department") demal for the intended use is contained in Mr. Tom <br /> Passanisi's letter of August 9, 2002 regarding the zoning ordinance decision <br /> alleging "zoning non-conformance". <br /> <br /> Innovations' appeal of this decision is based on its disagreement with allegation <br /> that its use does not conform to the permitted uses and its disagreement with the <br /> reasons stated for the denial and the "zoning non-conformance" alleged as set forth <br /> in the letter from Tom Passanisi, Principal Planner, City of Redwood City, dated <br /> August 9, 2002, a copy of which is attached hereto, which letter is included herein <br /> by reference. <br /> <br /> Additionally, Innovations' appeal is based on the fact that the Department has <br /> applied additional requirements not set forth in any zoning code, ordinance, <br />-- regulation, memorandum, or other official writing of the Redwood City <br /> Community Development Services depa, tment or the City of Redwood City, which <br /> standard was established ancl/or published by the City, and which was open to <br /> public scrutiny or available for examiuation by the public. Specifically, the <br /> Department has applied additional requiremen.s regarding "retail sales" and has <br />- required that such retail business be "open to the public". These requirements are <br /> not ~known by or available to the public and thus are secret requirements.
