control program and the actual revenue received to offset these <br />costs. Any variance (deficit or surplus) over what was budgeted <br />will be added to, in the case of a deficit, or subtracted from, in <br />the case of a surplus, the following year's cost. Deficits and/or <br />surpluses are shared by each CITY and COUNTY based on actual <br />program costs and revenue for the prior fiscal year. If CITY, <br />COUNTY or State laws are passed during the term of this contract <br />that require a greater level of service, CITY agrees to reimburse <br />COUNTY for additional costs associated with implementing the new <br />laws. <br /> <br /> 7. Maintenance of Records. Records of animals impounded <br />including the description of each animal, date of receipt, date and <br />manner of disposal, treatment received, the name of the person <br />redeeming or adopting the animal, and the fees, charges and <br />proceeds of adoption shall be maintained by COUNTY, through COUNTY <br />CONTRACTOR, and made available to CITY. In addition, statistical <br />information shall be provided on a monthly basis to the CITY <br />summarizing various field enforcement activities occurring in the <br />CITY and shelter activities initiated by residents of said CITY. <br /> <br /> 8. Term and Effective Period: The term of this Agreement <br />shall be for a period of three years, commencing July 1,2000, and <br />ending, June 30, 2003. <br /> <br /> 9. Termination of Agreement: <br /> (a) The legislative body of either party may terminate this <br /> agreement on any January 1 or July ! provided that six-months' <br /> prior wr~_uten notice is given. CITY may terminate its <br /> participasion in either the Countywide field enforcement or <br /> shelter service program or both as long as the CITY assumes <br /> the financial and programmatic responsibility for the <br /> provision of analogous field enforcement and/or shelter <br /> services. If CITY terminates this agreement and services under <br /> this contract have been provided, but CITY has not made <br /> payment for those services, then CITY is responsible for <br /> payraent of those services on a prorated basis. <br /> <br /> <b) This agreement shall automatically terminate in the event <br /> cf ~e_~n~ina~ion of the COUNTY's contract with COUNTY <br /> CONTRACTOR. Upon termination COUNTY shall have no further <br /> obligation to provide the services specified in this <br /> agreement. <br /> <br /> i0. Amendments: Entire Agreement.
