The Planning Commission, having independently heard, considered <br />and weighed all the evidence in the record, finds that the above recitals are accurate <br />and constitute findings in this matter and, together with the staff report and the <br />application materials, including without limitation the development plans, and all other <br />documents, reports, studies, memoranda, maps, oral and written testimony, and <br />materials in the City's file for the application, and all adopted City planning documents <br />relating to the Project and the property including the City's General Plan, Zoning <br />Ordinance, Municipal Code, other applicable City laws and regulations, and all <br />associated approved and certified environmental documents, have together served as <br />an adequate and appropriate evidentiary basis for the findings and actions set forth in <br />this Resolution. <br />Section 2. CEQA: The Planning Commission finds that the proposed Project is <br />exempt from the requirements of the California Environmental Quality Act under Section <br />15303(e), Class 3, for the construction of an accessory structure. In addition, the <br />Planning Commission finds that the Project would not cause a substantial adverse <br />change in the significance of a historic resource as it is a small informational kiosk at the <br />entrance of the cemetery that does not alter or affect any of the existing features of the <br />site and is designed to be architecturally compatible with other structures on the site. <br />Section 3. Historic Preservation Ordinance Findings: The Planning <br />Commission finds that the proposed Project meets the Permit Approval Criteria as listed <br />in Historic Preservation Ordinance Section 40.10, specifically Criteria A and C: <br />A. In the case of any property designated a historic landmark, the <br />proposed work would not detrimentally alter, destroy or adversely affect <br />any exterior architectural feature. <br />The proposed work would not alter, destroy, or adversely affect any exterior <br />architectural feature because the kiosk would be located at the entrance of <br />the cemetery where there are currently no exterior architectural features. <br /> <br />C. In the case of construction of a new improvement, building, or structure <br />upon a historic site, the exterior of such improvements will not <br />adversely affect and will be compatible with the external appearance of <br />existing designated improvements, buildings, and structures on said <br />site. <br />The project considers the existing structures and design within the site, and <br />utilizes similar colors and architectural styles to be compatible. <br /> <br />Section 4. Architectural Permit: AP2018-039 (Section 45.4): The Planning <br />Commission finds that the required findings for an Architectural Permit can be made: <br />A. The existence of sufficient variety in the design of the structure and <br />grounds to avoid monotony in the external appearance.
