10/22/2018 <br />impassable for vehicular travel and no public money was expended by the City for <br />maintenance during such period; and <br />WHEREAS, the County of San Mateo proposes to convey and City Council desires <br />to accept the quitclaim deed and easement quitclaim deed substantially in the forms <br />shown in Exhibit D and Exhibit E, respectively, attached hereto and incorporated herein <br />by reference; and <br />WHEREAS, City Council desires to convey to the County of San Mateo the <br />quitclaim deed substantially in the form shown in Exhibit F, attached hereto and <br />incorporated herein by reference; and <br />WHEREAS, the public street to be vacated by the City is not useful as a non - <br />motorized transportation facility as sufficient facilities are provided in the realigned <br />roadway. <br />NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF <br />REDWOOD CITY AS FOLLOWS: <br />1. The recitals set forth above are true and correct, and are hereby <br />incorporated herein by this reference as if fully set forth in their entirety. <br />2. Resolution No. 15034 is hereby rescinded. <br />3. Pursuant to Section 8331 of the California Streets and Highways Code, for <br />a period of five consecutive years said portion of a public street has been impassable for <br />vehicular travel and no public money was expended by the City for maintenance during <br />such period. <br />4. The portion of a public street described in Exhibit A and depicted in Exhibit <br />B and Exhibit C, is hereby ordered vacated. From and after the date this resolution is <br />recorded, the public street vacated shall no longer constitute a public street. <br />5. The City Manager is hereby authorized and directed, upon receipt of a <br />signed deed from the County of San Mateo, to accept on behalf of the City of Redwood <br />City and execute the Certificate of Acceptance for the quitclaim deed and easement <br />quitclaim deed substantially in the forms shown in Exhibit D and Exhibit E, respectively. <br />6.
