hours after the notice is deposited in the United States mail, first-class, registered or certified, postage prepaid <br />and addressed to the recipient at the address that the recipient has provided the Association for receipt of <br />notice or, if no such address was provided, at the recipient's Lot address in the Development. <br />12.14 No Enforcement Waiver. Failure to enforce a restriction in the past in and of itself shall not <br />constitute a defense to any action brought against any Owner for violation of any restriction contained herein. <br />Each Owner, by acceptance of a deed to a Lot in the Development, acknowledges that the enforcement of <br />these restrictions may vary as a result of different Owners or Boards, changing conditions, or other reasons <br />and agrees that the failure of any Owner or Board to enforce any particular restriction, even if such failure is <br />for an extended period of time, shall not in any manner restrict or estop the right of any Owner or Board to <br />enforce these restrictions at any future time. <br />12.15 Statutory Reference. Any reference to a governmental statute in this Declaration includes <br />any amendments to the statute. If the statute is replaced by an equivalent statute, the equivalent statute shall <br />be the applicable statute.
