THE GROVE <br />DECLARATION OF RESTRICTIONS (CC&Rs) <br />THIS DECLARATION OF RESTRICTIONS (CC&Rs) is executed by LIBERTY HALL LANE <br />PARTNERS LP, a California limited partnership (the "Declarant') with reference to the following facts: <br />A. Declarant is constructing a residential development consisting of 8 residential lots <br />and 1 Common Area lot located on certain real property in Redwood City, California, <br />more particularly described on the subdivision map entitled "Final Map No. 2016-003 <br />The Grove' filej in the records of San Mateo County, California, on <br />September 'L 2016, in Book j I of Maps at pages <br />(the "Map"). <br />B. Declarant desires to impose certain restrictions on the lots in the development that <br />will benefit and bind each lot, and each owner and successive owner thereto, as <br />covenants running with the land and equitable servitudes, to grant and describe <br />certain easements that will be appurtenant to the lots and/or in favor of the <br />homeowners association, and to establish a planned development within the <br />meaning of Civil Code section 4175. <br />DECLARANT DECLARES AS FOLLOWS: <br />ARTICLE 1 <br />Definitions <br />Unless the context indicates otherwise, the following terms shall have the following definitions: <br />1.1 Applicable Laws. All federal, state and local laws, statutes, acts, ordinances, rules, <br />regulations, permits, licenses and requirements of all governmental authorities (including any agency, <br />authority, board, branch, division, department or similar unit of any federal, state, county, district or other <br />governmental entity having jurisdiction over the Development) that now or hereafter during the term of this <br />Declaration may be applicable to a residential common interest development. <br />1.2 Articles. The Articles of Incorporation of the Association and any amendments thereto. <br />1.3 Association. The Grove Liberty Hall Lane Homeowners Association, a California nonprofit <br />mutual benefit corporation. <br />1.4 Board. The Board of Directors of the Association. <br />1.5 Bylaws. The Bylaws of the Association and any amendments thereto. <br />1.6 City. The City of Redwood City, California. <br />1.7 Common Area. Parcel A as shown on the Map. <br />1.8 Davis -Stirling Act. The Davis -Stirling Common Interest Development Act as set forth in Part 5 <br />(commencing with Civil Code section 4000) of Division 4 of the Civil Code and any subsequent modifications <br />thereto. <br />August 18, 2016 <br />
