10/22/2018 <br />RESOLUTION NO. 15708 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br />REDWOOD CITY RESCINDING RESOLUTION 15034; SUMMARILY <br />VACATING A PORTION OF A PUBLIC STREET IN THE CITY OF <br />REDWOOD CITY PURSUANT TO PART 3 OF DIVISION 9 OF THE <br />CALIFORNIA STREETS AND HIGHWAYS CODE; AUTHORIZING <br />THE CITY MANAGER TO ACCEPT QUITCLAIM DEEDS IN <br />EXCHANGE THEREFOR; AUTHORIZING THE CITY MANAGER TO <br />EXECUTE A QUITCLAIM DEED; AND DIRECTING THE CITY CLERK <br />TO FILE THE RESOLUTION AND DEEDS FOR RECORDATION <br />(WINSLOW STREET REALIGNMENT) <br />WHEREAS, pursuant to California Streets and Highways Code Division 9, Part 3, <br />Chapter 4 (commencing at Section 8330), the City Council ("City Council") of the City of <br />Redwood City ("City") may summarily vacate a street or highway; and <br />WHEREAS, on July 12, 2010, the City Council approved Resolution No. 15034 <br />ordering that a portion of Winslow Street, a public street in the City, be vacated; and <br />WHEREAS, Section 8336 of the California Streets and Highways Code states that <br />upon recordation of a certified copy of a resolution of vacation in the office of the recorder, <br />such as Resolution No. 15034, the vacation is complete; and <br />WHEREAS, a certified copy of Resolution No. 15034 has not been recorded in the <br />office of the recorder, and the facts surrounding the statements in Resolution No. 15034 <br />requiring reservation of a 20 -foot wide easement for PG&E gas line facilities have <br />changed such that a reservation is no longer required; and <br />WHEREAS, pursuant to an Agreement for Exchange of Real Property between <br />the City and the County of San Mateo dated February 8, 2005, the City Council desires <br />to carry out its obligations therein by rescinding Resolution No. 15034 and reaffirming the <br />intent of the City by adopting this resolution; and <br />WHEREAS, the portion of a public street to be vacated is described in Exhibit A <br />and depicted in Exhibit B and Exhibit C, attached hereto and incorporated herein by <br />reference; and <br />WHEREAS, pursuant to Section 8331 of the California Streets and Highways <br />Code, for a period of five consecutive years said portion of a public street has been <br />ATTV/RESO.0094/CC RESO RESCINDING RESOLUTION 15034- WINSLOW STREET REALIGNMENT RESO.
