E. CITY shall obtain yearly recertification and training of the canine. Annual recertification and training expenses for handler and dog may be submitted to NC HIDTA for consideration of reimbursement, based on the availability of grant funds. F. CITY shall advise NCHIDTA and Metro Task Force I that CITY intends to handle and direct canine in accordance with Redwood City Police Department Policy #318, Canine Program and that directives or request that are or appear non-compliant with the CITY's policy may be rejected or refused. 3. NCHIDTA's Responsibilities and Cost -Sharing Obligations for Canine A. NCHIDTA will promptly reimburse CITY from funds allocated to the Designated TFO's assigned NCHIDTA Initiative upon invoice for: the purchase of the canine (including selection, shipping, crating, and preliminary veterinary check); basic handler's course to include a California POST Certification, as well as lodging and travel reimbursement in accordance with federal GSA per diem policy; and one year of maintenance training for the canine. B. NCHIDTA will in good faith and for a minimum of five (5) years from date of purchase consider reimbursing CITY for annual recertification and training and associated expenses, which may be granted subject to availability of grant funds. C. NCHIDTA acknowledges that CITY intends to handle and direct canine in accordance with Redwood City Police Department Policy #318, Canine Program and that directives or request that are appear non-compliant with the CITY's policy may be rejected or refused. 4. Early Termination of Agreement and Reimbursement. If CITY discontinues the currently Designated TFO's assignment to Metro Task Force I earlier than five (5) years from the date of purchase of the canine, CITY shall reimburse NCHIDTA for a pro rate share of the monies it paid to CITY in accordance with this Agreement based on the number of months remaining in the five (5) year period. For example, if the assignment is terminated in month 24 of 60 months, then CITY owes NCHIDTA reimbursement for 36/60 (or 3/5) worth of the monies it paid. 5. Indemnification A. To the extent, the canine that is the subject of this Agreement is engaged in a Metro Task Force I /NCHIDTA or related action, operation, or activity, the parties agree to mutual indemnifications as follows: Each party shall indemnify, defend, protect, hold harmless, and release the other, its officers, agents, and employees, from and against any and all claims, loss, proceedings, damages, causes of action, liability, costs, or expense (including REV: 11-20-18 PT Page 4 of 6 ATTY/AG R.2018.267/DEA
