E. CITY shall obtain yearly recertification and training of the canine. Annual recertification <br />and training expenses for handler and dog may be submitted to NC HIDTA for <br />consideration of reimbursement, based on the availability of grant funds. <br />F. CITY shall advise NCHIDTA and Metro Task Force I that CITY intends to handle and <br />direct canine in accordance with Redwood City Police Department Policy #318, Canine <br />Program and that directives or request that are or appear non-compliant with the CITY's <br />policy may be rejected or refused. <br />3. NCHIDTA's Responsibilities and Cost -Sharing Obligations for Canine <br />A. NCHIDTA will promptly reimburse CITY from funds allocated to the Designated TFO's <br />assigned NCHIDTA Initiative upon invoice for: the purchase of the canine (including <br />selection, shipping, crating, and preliminary veterinary check); basic handler's course to <br />include a California POST Certification, as well as lodging and travel reimbursement in <br />accordance with federal GSA per diem policy; and one year of maintenance training for <br />the canine. <br />B. NCHIDTA will in good faith and for a minimum of five (5) years from date of purchase <br />consider reimbursing CITY for annual recertification and training and associated <br />expenses, which may be granted subject to availability of grant funds. <br />C. NCHIDTA acknowledges that CITY intends to handle and direct canine in accordance <br />with Redwood City Police Department Policy #318, Canine Program and that directives <br />or request that are appear non-compliant with the CITY's policy may be rejected or <br />refused. <br />4. Early Termination of Agreement and Reimbursement. <br />If CITY discontinues the currently Designated TFO's assignment to Metro Task Force I earlier <br />than five (5) years from the date of purchase of the canine, CITY shall reimburse NCHIDTA for <br />a pro rate share of the monies it paid to CITY in accordance with this Agreement based on the <br />number of months remaining in the five (5) year period. For example, if the assignment is <br />terminated in month 24 of 60 months, then CITY owes NCHIDTA reimbursement for 36/60 (or <br />3/5) worth of the monies it paid. <br />5. Indemnification <br />A. To the extent, the canine that is the subject of this Agreement is engaged in a Metro Task <br />Force I /NCHIDTA or related action, operation, or activity, the parties agree to mutual <br />indemnifications as follows: <br />Each party shall indemnify, defend, protect, hold harmless, and release the other, <br />its officers, agents, and employees, from and against any and all claims, loss, <br />proceedings, damages, causes of action, liability, costs, or expense (including <br />REV: 11-20-18 PT <br />Page 4 of 6 <br />ATTY/AG R.2018.267/DEA <br />
