6.13. - Page 4 of 36 <br />t� ► � t, ► • • ' lJ L.L. : L r ti = <br />THIS FIRST AMENDMENT TO Stormwater Treatment Measures Maintenance <br />Agreement, 815 Hamilton Street, ("First Amendment") is made and entered into this <br />day of , 2018 ("Effective Date"), by and between Hamilton & Winslow <br />Properties, LLC, a California limited liability company ("H&WP"), and the CITY OF <br />REDWOOD CITY, a charter city and California municipal corporation (City"). <br />A. H&WP and City entered into that certain Stormwater Treatment Measures <br />Maintenance Agreement dated October 24, 2015 and recorded December 1, 2015 as <br />instrument Number 2015-126535, in the Official Records of the County of San Mateo <br />("Stormwater Treatment Measures Maintenance Agreement"). <br />B. The Stormwater Treatment Measures Maintenance Agreement included <br />references to a legible reduced -scale copy of the site plan showing the stormwater <br />treatment measures that are to be located or constructed on the Property ("Site Plan") <br />and installed and maintained by the agreement as shown on Exhibit B attached to the <br />Stormwater Treatment Measures Maintenance Agreement. <br />C. Since the recordation of the Stormwater Treatment Measures <br />Maintenance Agreement, an additional treatment facility was installed during the <br />construction of the stormwater treatment measures which required modifications to the <br />Site Plan. Winslow requested these modifications to the stormwater treatment <br />measures, and in doing so was required to alter the Site Plan. <br />D. The revised Site Plan is further detailed on Revised Exhibit B to this First <br />Amendment. <br />NOW, THEREFORE, HW&P and the City hereby amend the Stormwater <br />Treatment Measure Maintenance Agreement as follows: <br />1. Exhibit B to the Stormwater Treatment Measures Maintenance Agreement <br />is of no further force and effect and is hereby replaced with Revised Exhibit B, attached <br />hereto and incorporated by reference. <br />2. In all other respects the Stormwater Treatment Measures Maintenance <br />Agreement shall remain in full force and effect. <br />3.
