Code § 27383. <br />UUPROVEMENT AGREEMENT <br />815 Hamilton Street <br />5 IMPROY5MENT AGREEMENT ("Agreement") is made and entered into on this _ day of _ <br />20"Effective Date") by and between by and between HAMILTON & <br />PROP RT1ES, LLC, a California limited liability company ("Developer"), and the <br />CITY OF REDWOOD CITY, a charter city and California municipal corporation ("City") with <br />reference to the following facts: <br />RECITALS <br />A. Developer is the current fee owner of that certain real property consisting of <br />approximately 0.5 acres located within the City of Redwood City, County of San Mateo, State of <br />California, described in Exhibit A, attached hereto and incorporated herein by reference (the "Property"). <br />B. On July 24, 2015, the City Council of the City of Redwood City adopted, among other <br />approvals, Resolution No. 15431, approving the Tentative Parcel Map for the project located at 815 <br />Hamilton Street ("Project'), prepared by BKF Engineers and dated June 5, 2015 ("Tentative Map'), <br />subject to certain conditions of approval ("Conditions"). <br />C. The Conditions require either (1) that certain public improvements for the Project be <br />constructed prior to approval of the parcel map ("Final Map's, or (2) that Developer enter into an <br />agreement with City providing for the future construction of such public improvements. <br />D. Developer has submitted the Final Map and applied to City for Final Map approval <br />without having. completed the required public improvements and, therefore, will enter into an agreement <br />with City providing for the future construction and installation of such public improvements, as required <br />by Government Code section 66462(a)(1). <br />E. Developer has submitted to City plans, specifications and drawings entitled Winslow <br />Street Development Improvement Plans, prepared by BKF Engineers and datedCtftb#- Z20]5 (the <br />"Improvement Plans"), which, in addition to other improvements, provide for certain on -`site public <br />improvements consisting of street and street light improvements, storm drain systems, domestic water <br />systems and sanitary sewer systems for the Project (collectively, "Improvements"). <br />F.
