2.2 Property Usage. The use of the Subject Premises by Permittee shall be limited solely to <br />underground conduits with communication lines and storm drain lines for drainage purposes and <br />related uses as set forth in this Permit. <br />2.3 Permit Revocable. This Permit does not constitute a deed, grant of easement, lease, conveyance, <br />or transfer of any property interest and is revocable without cause at any time at the will of the <br />Council of the City of Redwood City, effective immediately upon giving notice of such revocation <br />to Permittee. <br />2.4 Permitted Installations. During the term of this Permit, Permittee may install, maintain, operate, <br />relocate and remove the Facilities within the Subject Premises subject to the issuance of required <br />encroachment and building permits and approvals. The Facilities shall be shown and described in <br />permit applications filed with the City Engineer and may be modified by subsequent permits <br />approved by the City. All Facilities to be installed, maintained, operated, relocated and removed <br />under this Permit shall be underground. <br />2.5 No Cost to City. The construction, installation, operation, maintenance, and removal of any <br />Facilities shall be accomplished (i) without cost or expense to the City and (ii) subject to the prior <br />approval of the City Engineer. Permittee shall maintain any such Facilities at all times in good and <br />safe condition and free from any nuisance to the satisfaction of the City Engineer. <br />2.6 Compliance with Code. Permittee shall comply with the provisions of the Redwood City Code, as <br />may be amended from time to time (the "Code"), including Chapter 11, Privately Owned Utilities, <br />and Chapter 29 Streets, Sidewalks and Work In or Use of City Right -of -Way. Permittee shall also <br />comply with applicable provisions of the City's Zoning Code, as amended from time to time (the <br />"Zoning Code"). In the event of a conflict between this Permit and the Code and/or the Zoning <br />Code, the provisions of the Code and/or the Zoning Code shall apply. <br />2.7 Encroachment Permits. All work performed by Permittee under this Permit shall be made <br />pursuant to individual encroachment permits. Permittee shall obtain encroachment permits from <br />the City for the installation of the Facilities and for any other work or activities within the City's <br />Public Rights -Of -Way as required by Chapter 29 of the Code. Permittee shall submit all plans, <br />schedules, and information required by the Code and the City Engineer. Permittee also shall <br />submit all required fees, cash deposits, bonds or other security required by the City Engineer in <br />accordance with the Code. All work within the Subject Premises shall be performed in strict <br />compliance with the terms and conditions of this Permit, the Code, and the pertinent <br />encroachment permit. Once a permit is issued, Permittee shall commence work and complete the <br />construction and installation of the Facilities in accordance with the Code and any construction <br />schedule approved by the City Engineer in the applicable permit. <br />2.8 Compliance with Laws and Regulations. Permittee shall at all times during the duration of this <br />Permit, comply with all state, federal and local laws and regulatory requirements, including, <br />without limitation, the California Environmental Quality Act, zoning laws, and construction codes. <br />Permittee shall at all times employ reasonable care so as not to endanger personnel or property <br />or unreasonably obstruct travel on any Public Rights -Of -Way (including the Subject Premises) and <br />shall install, maintain and use commonly accepted industry methods and devices for preventing <br />failures and accidents that are likely to cause damage, injury or nuisance to the public or other <br />users of the Public Rights -Of -Way, public property or private property. <br />Page 2 of 24 <br />REV: 09-17-18 PR <br />ATTY/AGR.2018.220/Kaiser- Revocable Encroachment Permit <br />
