We note that the agenda for tonight's meeting indicates that the City <br />Council plans to adopt the Proposed Ordinance and Draft Resolution on initial reading. <br />Given the importance of this legislation, AT&T respectfully requests and recommends that <br />the Council pause its deliberations briefly in order to be able to consider input from the <br />wireless services industry. <br />AT&T appreciates the City's effort to update its zoning code based on recent <br />advancements in wireless technologies and the Federal Communications Commission's <br />Infrastructure Order. AT&T also appreciates both the City's recognition of the importance <br />of wireless service to local residents and businesses and the need to comply with Federal and <br />State law. <br />The following are initial comments AT&T has regarding the Proposed Ordinance <br />and Draft Resolution: <br />1. Application Fee. Section 29.106(d) of the Proposed Ordinance allows the City to <br />determine the amount of a non-refundable application fee for each application for a wireless <br />encroachment permit. Section 29.106(d) states that this fee "shall be the same feen required <br />for an encroachment permit under this Chapter 29 of the City Code," which presumably <br />refers to RCMC Section 29.26. If by "same fee" the City means the same amount and not in <br />addition to the fee for a Chapter 29 encroachment permit, the fee may be fine so long as it is <br />consistent with the FCC standard. <br />
