E. Attached hereto as Exhibit "C" and incorporated herein by this reference, is an "Inspection and Maintenance Checklist" which describes the Property Owner's maintenance activities to be performed pursuant to this Agreement; and F. The City is the permittee public agency with jurisdiction over the Site Plan and the identified stormwater treatment measures on the Property; and G. The Property Owner recognizes that the stormwater treatment measure(s) more particularly described and shown on the Site Plan, of which full-scale plans and any amendments thereto are on file with the Engineering & Transportation Division of the City of Redwood City, must be installed and maintained as indicated in this Agreement and as required by the NPDES Permit and other regulatory agencies having jurisdiction over stormwater treatment measures on the Property; and H. The City and Property Owner agree that the health, safety and welfare of the citizens of the City require that the stormwater treatment measure(s) detailed in the Site Plan be constructed and maintained on the Property; and I. The City's Stormwater Management Ordinance and Stormwater related guidelines, criteria and other written directions ("City Stormwater Regulations") require that the stormwater treatment measure(s), as shown on the approved Site Plan, be constructed and maintained by the Property Owner, with City inspections and oversight as further detailed in this Agreement. AGREEMENT NOW, THEREFORE, in consideration of the benefits set forth in this Agreement, the parties hereby covenant and agree as follows: 1. Construction of Treatment Measures. The on-site stormwater treatment measures shown on the Site Plan ("Stormwater Treatment Measures") shall be constructed by the City in strict accordance with the approved plans and specifications identified forthe Property and any other requirements necessary to comply with City Stormwater Regulations and all applicable laws. The City will coordinate the construction of the Stormwater Treatment Measures with the Property Owner during construction and ensure that the Property Owner has sufficient access to its Property. Temporary site construction fencing will be installed by the City during construction activities to provide adequate site protection and separation of City and Property Owner activities, and City shall require all contractors to comply with the terms of the Criminal Background and Fingerprint form attached hereto as Exhibit "D". 2. Design and Construction Responsibility. City shall be solely responsible for the engineering and design, and construction of the Stormwater Treatment Measures, and the costs thereof, in accordance with the parameters depicted in the Site Plan. City shall comply with the insurance and indemnification requirements contained within this Agreement. a. Upon completion of the installation of the Stormwater Treatment Measures, at no cost to Property Owner, City shall restore the staging and access areas, and the site, to the condition they are in as of the date of this Agreement, including the repair or replacement of any and all damage to the land, fixtures, appurtenances, installations, improvements, structures and/or other property located on, over, under, across, upon, and around the site REV: 07-27-18 PR Page 2 of 23 ATTY/AGR/2018.162/REDWOOD CITY SCHOOL DISTRICT- STMMA
