E. Attached hereto as Exhibit "C" and incorporated herein by this reference, <br />is an "Inspection and Maintenance Checklist" which describes the Property Owner's <br />maintenance activities to be performed pursuant to this Agreement; and <br />F. The City is the permittee public agency with jurisdiction over the Site Plan <br />and the identified stormwater treatment measures on the Property; and <br />G. The Property Owner recognizes that the stormwater treatment measure(s) <br />more particularly described and shown on the Site Plan, of which full-scale plans and any <br />amendments thereto are on file with the Engineering & Transportation Division of the City of <br />Redwood City, must be installed and maintained as indicated in this Agreement and as <br />required by the NPDES Permit and other regulatory agencies having jurisdiction over <br />stormwater treatment measures on the Property; and <br />H. The City and Property Owner agree that the health, safety and welfare of the <br />citizens of the City require that the stormwater treatment measure(s) detailed in the Site Plan <br />be constructed and maintained on the Property; and <br />I. The City's Stormwater Management Ordinance and Stormwater related <br />guidelines, criteria and other written directions ("City Stormwater Regulations") require that <br />the stormwater treatment measure(s), as shown on the approved Site Plan, be constructed <br />and maintained by the Property Owner, with City inspections and oversight as further <br />detailed in this Agreement. <br />AGREEMENT <br />NOW, THEREFORE, in consideration of the benefits set forth in this Agreement, the <br />parties hereby covenant and agree as follows: <br />1. Construction of Treatment Measures. The on-site stormwater treatment measures <br />shown on the Site Plan ("Stormwater Treatment Measures") shall be constructed by the City <br />in strict accordance with the approved plans and specifications identified forthe Property and <br />any other requirements necessary to comply with City Stormwater Regulations and all <br />applicable laws. The City will coordinate the construction of the Stormwater Treatment <br />Measures with the Property Owner during construction and ensure that the Property Owner <br />has sufficient access to its Property. Temporary site construction fencing will be installed by <br />the City during construction activities to provide adequate site protection and separation of <br />City and Property Owner activities, and City shall require all contractors to comply with the <br />terms of the Criminal Background and Fingerprint form attached hereto as Exhibit "D". <br />2. Design and Construction Responsibility. City shall be solely responsible for the <br />engineering and design, and construction of the Stormwater Treatment Measures, and the <br />costs thereof, in accordance with the parameters depicted in the Site Plan. City shall comply <br />with the insurance and indemnification requirements contained within this Agreement. <br />a. Upon completion of the installation of the Stormwater Treatment Measures, at <br />no cost to Property Owner, City shall restore the staging and access areas, and the site, to <br />the condition they are in as of the date of this Agreement, including the repair or replacement <br />of any and all damage to the land, fixtures, appurtenances, installations, improvements, <br />structures and/or other property located on, over, under, across, upon, and around the site <br />REV: 07-27-18 PR Page 2 of 23 <br />ATTY/AGR/2018.162/REDWOOD CITY SCHOOL DISTRICT- STMMA <br />
